About procedure for pronouncement of instructions about suspension of placement, the redemption, exchange of investment shares

Based on paragraph two of part two of Item 2 of article 5 of the Law of the Republic of Belarus of July 17, 2017 "About investment funds", Item 10 of the Regulations on the Ministry of Finance of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of October 31, 2001 No. 1585 "Questions of the Ministry of Finance of the Republic of Belarus", the Ministry of Finance of the Republic of Belarus DECIDES:

1. Determine that:

1.1. instructions about suspension of placement, the redemption, exchange of investment shares are taken out by the Ministry of Finance of the Republic of Belarus in cases of identification of violations of requirements of the Law of the Republic of Belarus of July 17, 2017 "About investment funds" (The national legal Internet portal of the Republic of Belarus, 22.07. 2017, 2/2490), other acts of the legislation of the Republic of Belarus of securities or of economic societies or impossibility of performance of contractual commitments management company of mutual investment fund, specialized depositary, auditing organization (the auditor performing activities as the individual entrepreneur), the contractor of assessment who is the legal entity, or the appraiser - the individual entrepreneur, other persons if as a result of such violation or such impossibility the rights and legitimate interests of owners of investment shares are violated;

1.2. instructions about suspension of placement, the redemption, exchange of investment shares are constituted according to appendix to this resolution and in day of their removal go:

1.2.1. in case of suspension of placement of investment shares:

the management company of mutual investment fund which performed issue of investment shares;

to specialized depositary of mutual investment fund;

to Central Securities Depository in the Republic of Belarus (further - the central depositary), to the depositaries performing accounting of investment shares, rights to them, encumbrances (restrictions) of these rights - for ensuring blocking of investment shares in depositary system;

to organizers of the securities trading in whose trade systems placement of investment shares is performed - for ensuring suspension of the biddings with investment shares (if placement of investment shares is performed in the organized market);

1.2.2. in case of suspension of the redemption and (or) exchange of investment shares:

the management company of mutual investment fund which performed issue of investment shares;

to specialized depositary of mutual investment fund;

to the central depositary, depositaries performing accounting of investment shares, rights to them, encumbrances (restrictions) of these rights - for ensuring blocking of investment shares in depositary system.

In case of suspension of the redemption and (or) exchange of investment shares during the placement of these shares performed later the ends of forming of mutual investment fund, the instruction about suspension of placement, the redemption, exchange of investment shares go also to organizers of the securities trading in whose trade systems placement of investment shares is performed, - for ensuring suspension of the biddings with investment shares (if placement of investment shares is performed in the organized market);

1.3. placement, the redemption, exchange of investment shares stop from the date specified in the instruction before elimination of the violations which served as the reason of such suspension.

In case of suspension of the redemption and (or) exchange of investment shares the placement of these shares performed after the end of forming of mutual investment fund at the same time stops.

2. This resolution becomes effective since July 23, 2018.
