Approve the Procedure for informing owners (co-owners) of the building by the operator of external engineering networks about intention of installation of node of commercial accounting which is applied.

Procedure for informing owners (co-owners) of the building by the operator of external engineering networks on intention of installation of node of commercial accounting

1. This Procedure determines general requirements and the mechanism of informing owners (co-owners) of the building by the operator of external engineering networks on intention of installation of node of commercial accounting.

2. In this Procedure terms are used in the value given in the Laws of Ukraine "About commercial accounting of heat energy and water supply", "About features of implementation of the property right in the apartment house".

3. The operator of external engineering networks at least in two months prior to installation of node of commercial accounting reports to owners (co-owners) of the building about intention to establish such node in form according to appendix (further - the notification).

4. The notification is brought to the attention of owners (co-owners) of the building by placement:

on the official website of the operator of external engineering networks, and in case of lack of such website - on the official website of local government body;

in the public place at information stands at building entrances.

The operator provides bringing to data of owners (co-owners) of the building of information on intention to establish node of commercial accounting by the notification on paper of each owner (co-owner) of the building within thirty days from the date of placement of the message on the official website of the operator of external engineering networks, and in case of lack of such website - on the official website of local government body and in the public place at information stands at building entrances.

5. Day of receipt of the notification by owners (co-owners) of the building is date of placement of the notification on the official website of the operator of external engineering networks, and in case of lack of such website - on the official website of local government body.

In case of lack of the website at the operator of external engineering networks and local government body day of receipt of the notification is date of placement of the notification in the public place at information stands at building entrances.

6. Owners (co-owners) of the building within two months from the date of receipt of the notification have the right to tell the operator of external engineering networks (at the choice) about:

consent to installation of node (nodes) of commercial accounting on terms offered by the operator of external engineering networks;

intention to approve with the operator of external engineering networks excellent from offered installations of node (nodes) of commercial accounting;

intention to independently equip the building with node (nodes) of commercial accounting in the procedure established by the legislation.

7. The disputes arising between the operator of external engineering networks and owners (co-owners) of the building about intention of installation of node of commercial accounting are solved judicially.
