1. Determine the national operator by trunk gas pipeline Intergas Central Asia joint-stock company.

2. Approve the enclosed Regulations on the national operator on trunk gas pipeline.

3. This resolution becomes effective from the date of its signing.

Regulations on the national operator on trunk gas pipeline

Chapter 1. General provisions

1. This Regulations on the national operator on trunk gas pipeline are developed according to the subitem 3) of article 5 of the Law of the Republic of Kazakhstan of June 22, 2012 "About the bulk distribution line" and determine powers, the main objectives and functions of the national operator by trunk gas pipeline (further - the national operator).

2. The national operator in the activities is guided by the Constitution of the Republic of Kazakhstan, the Law of the Republic of Kazakhstan of June 22, 2012 "About the bulk distribution line" and other regulatory legal acts of the Republic of Kazakhstan, international treaties ratified by the Republic of Kazakhstan, and also this Provision.

Chapter 2. Tasks and functions of the national operator

3. Activities of the national operator are aimed at the development of gas trunk pipeline system in the Republic of Kazakhstan, ensuring their effective, reliable and safe operation.

4. The main objectives of the national operator are:

1) ensuring interests of the Republic of Kazakhstan and other participants of the relations when transporting commodity gas by trunk gas pipelines on the internal and external markets;

2) ensuring innovative development of gas trunk pipeline system and its integration into world power system, increase in energy potential of the state by means of diversification of flows of commodity gas;

3) ensuring balance in the mode of transportation of commodity gas between the export directions on trunk gas pipelines and transportation of commodity gas to the internal consumers connected to trunk gas pipelines including in the conditions of the peak mode of selection of commodity gas during the winter period;

4) operational-dispatching management of the interconnected mode of transportation of commodity gas on trunk gas pipelines of gas-transport system of the Republic of Kazakhstan;

5) quality assurance of commodity gas in trunk gas pipeline according to the technical requirements on quality of commodity gas established by normative and technical documents;

6) participation in development and accomplishment of the state and national development programs of oil-and-gas sector regarding transportation of commodity gas on trunk gas pipelines;

7) development and submitting for examination in authorized body of project proposals of the regulatory legal acts directed to enhancement of the legislation of the Republic of Kazakhstan on the bulk distribution line;

8) participation in project development normative and the specifications and technical documentation in the field of trunk gas pipelines;

9) participation in development and implementation of international treaties in the field of transportation of commodity gas through bulk distribution lines;

10) participation in work on implementation of the international projects directed to strengthening of energy security and diversification of routes of transportation of commodity gas.

5. National operator:

1) has rendering rights in the territory of the Republic of Kazakhstan of operator services in trunk gas pipeline, fifty and more percent of voting shares (shares) of the owner of which directly or indirectly belong to the state, national managing holding or the national company;

2) has rights of rendering services in the organization of transportation of the commodity gas for pipeline systems of other states transported from the territory of the Republic of Kazakhstan on the trunk gas pipeline belonging on the property right or other legal cause to the national operator (operator activities for single routing).

6. The national operator within realization of the right of rendering services in the organization of transportation of the commodity gas transported from the territory of the Republic of Kazakhstan for export (including transit) on the trunk gas pipelines belonging on the property right or other legal cause to the national operator performs the following functions:

1) signs with senders of products agreements for the organization of transportation of commodity gas for trunk gas pipelines;

2) based on the signed agreements for the organization of transportation of commodity gas for trunk gas pipelines signs the relevant agreements with the organizations, including the organizations of other states rendering transportation services of commodity gas, and other agreements necessary for ensuring transportation of the commodity gas transported from the territory of the Republic of Kazakhstan for export (including transit) on the trunk gas pipelines belonging on the property right or other legal cause to the national operator.

Chapter 3. Organization of activities

7. The national operator will organize the activities according to the legislation of the Republic of Kazakhstan, this Provision and the charter.

8. Reorganization and liquidation of the national operator are performed according to the legislation of the Republic of Kazakhstan.
