1. Approve the enclosed Rules of forming and functioning of information system of accounting of crude oil and gas condensate, sour gas and products of its conversion (commodity gas).

2. Declare invalid the order of the Minister of Energy of the Republic of Kazakhstan of March 18, 2015 No. 211 "About approval of Rules of forming and functioning of information system of accounting of oil" (registered in the Register of state registration of regulatory legal acts for No. 10828, published on May 19, 2015 in information system of law of Ad_let).

3. To provide to department of digitalization and state services of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic form in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions;

4) placement of this order on official Internet resource of the Department of Energy of the Republic of Kazakhstan after its official publication;

5) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 2), 3) and 4) of this Item.

4. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

5. This order becomes effective since June 29, 2018 and is subject to official publication.

Rules of forming and functioning of information system of accounting of crude oil and gas condensate, sour gas and products of its conversion (commodity gas)

Chapter 1. General provisions

1. These rules of forming and functioning of information system of accounting of crude oil and gas condensate, sour gas and products of its conversion (commodity gas) (further – Rules) are developed according to Item 2 of article 144 of the Code of the Republic of Kazakhstan "About subsoil and subsurface use" (further – the Code) and determine procedure for forming and functioning of information system of accounting of crude oil and gas condensate, sour gas and products of its conversion (commodity gas) (further – System).

2. According to Item 1 of article 144 of the Code the System is intended for the automated collection, processings, storages and uses of the data on quantity which are in circulation of crude oil and the gas condensate, prepared for delivery to the consumer according to the legislation of the Republic of Kazakhstan, about quantity which is in circulation of the sour gas prepared for conversion and delivery to the consumer according to the legislation of the Republic of Kazakhstan, and also used for own needs, which is subject to utilization by downloading in layer for the purpose of storage and (or) maintenance of the reservoir pressure burned in cases and on the terms of stipulated in Clause 146 Codes.

Chapter 2. Rules of forming of System

4. The subjects performing activities in the field of turnover of crude oil and gas condensate, sour gas and products of its conversion (commodity gas) (further – Subjects), provide to authorized body in the field of hydrocarbons (further – authorized body) access to the systems of accounting of the data on quantity which are in circulation of crude oil and the gas condensate, prepared for delivery to the consumer according to the legislation of the Republic of Kazakhstan, about quantity being in circulation of the sour gas prepared for conversion and delivery to the consumer according to the legislation of the Republic of Kazakhstan, and also used for own needs, which is subject to utilization by downloading in layer for the purpose of storage and (or) maintenance of the reservoir pressure burned in cases and on conditions, stipulated in Clause 146 Codes available for them (further – systems of Subjects).

When forming System the data from the metering devices established at the subjects performing activities in the field of turnover of crude oil and gas condensate, sour gas and products of its conversion (commodity gas) received within information exchange with Subjects are used.

5. For holding actions for forming and input in commercial operation of System the authorized body creates working group which part representatives of authorized body and other interested persons are.

6. Working group independently or with attraction as consultants and (or) experts of other organizations:

1) is developed by the schedule of carrying out the analysis of the available systems of Subjects;

2) is carried out by the analysis of the available systems of Subjects;

3) develops algorithms of integration of systems of Subjects and forming of System;
