About approval of additional requirements to functioning of electronic platform for the purposes of implementation of competitive purchase with participation of subjects of small and medium entrepreneurship

According to part 10 of article 3.4 of the Federal law "About Purchases of Goods, Works, Services as Separate Types of Legal Entities" Government of the Russian Federation decides:

1. Approve the enclosed additional requirements to functioning of electronic platform for the purposes of implementation of competitive purchase with participation of subjects of small and medium entrepreneurship.

2. This resolution becomes effective since July 1, 2018 and is applied to the relations connected with implementation of purchases of goods, works, services, notifications on which implementation are placed in unified information system in the field of purchases or invitations to take part in which are sent after start date of functioning of operators of electronic platforms who conform to the single requirements provided by the Federal Law "About Contractual System in the field of Purchases of Goods, Works, Services for Ensuring the State and Municipal Needs" and the additional requirements approved according to Item 1 of this resolution.

Additional requirements to functioning of electronic platform for the purposes of implementation of competitive purchase with participation of subjects of small and medium entrepreneurship

1. These additional requirements are imposed according to the Federal Law "About Purchases of Goods, Works, Services as Separate Types of Legal Entities" to electronic platform for the purposes of implementation of competitive purchase with participation of subjects of small and medium entrepreneurship (further respectively - competitive purchase, the procurement participant) which conforms to the single requirements provided by the Federal Law "About Contractual System in the field of Purchases of Goods, Works, Services for Ensuring the State and Municipal Needs" (further - single requirements).

2. The operator of an electronic trading platform shall provide carrying out competitive purchase according to requirements of the Federal Law "About Purchases of Goods, Works, Services as Separate Types of Legal Entities".

3. Start date of functioning of electronic platform for the purposes of implementation according to the Federal Law "About Purchases of Goods, Works, Services as Separate Types of Legal Entities" of competitive purchase is date of agreement signature about functioning of electronic platform, requirements to which are provided by single requirements, after provision of ensuring obligation fulfillment of the operator of an electronic trading platform under the specified agreement.

4. The operator of an electronic trading platform has no right:

a) refuse carrying out competitive purchase on electronic platform;

b) perform the actions provided by Articles 3.2 - 3.4 Federal Laws "About Purchases of Goods, Works, Services as Separate Types of Legal Entities", with involvement of the third parties.

5. When implementing competitive purchase by the operator of an electronic trading platform the payment for participation in competitive purchase in cases and procedure which are determined according to part 4 of article 24.1 of the Federal law "About Contractual System in the field of Purchases of Goods, Works, Services for Ensuring the State and Municipal Needs" can be levied.

6. The operator of an electronic trading platform signs agreements on interaction with each of the banks included in the list determined by the Government of the Russian Federation according to the Federal Law "About Contractual System in the field of Purchases of Goods, Works, Services for Ensuring the State and Municipal Needs" (further - bank). At the same time conditions of such agreement shall conform to the requirements established by the Government of the Russian Federation to conditions of the agreements provided by part 13 of article 44 of the Federal law "About Contractual System in the field of Purchases of Goods, Works, Services for Ensuring the State and Municipal Needs". The unreasonable refusal of the operator of an electronic trading platform of agreement signature about interaction with bank is not allowed. Interaction of the operator of an electronic trading platform and bank is performed electronically.

7. Safety of the money deposited by the participant of competitive purchase for the purpose of tender security on participation in purchase is provided by their introduction into the special account opened by the procurement participant in bank (further - the special bank account).

8. Blocking of the money deposited by the procurement participant for the purpose of tender security on participation in competitive purchase is performed in cases and procedure which are provided by part 15 of article 3.4 of the Federal law "About Purchases of Goods, Works, Services as Separate Types of Legal Entities".

9. The operator of an electronic trading platform sends to bank information for the termination of blocking of money on the special bank account of the procurement participant within 1 hour from the moment of approach of one of the following cases:

a) variation of the application for participation in competitive purchase;

b) cancellation by the customer of competitive purchase.

10. Regulations on purchase other cases of the direction by the operator of an electronic trading platform can be provided in bank of information for the termination of blocking of money on the special bank account of the procurement participant, except as specified, provided by part 17 of article 3.4 of the Federal law "About Purchases of Goods, Works, Services as Separate Types of Legal Entities" .

11. Use of the state information system performing fixing of legally significant actions, failure to act in unified information system on electronic platform when carrying out competitive purchase is performed by interaction of electronic platform with such system according to single requirements, and also with the requirements established by the Government of the Russian Federation according to part 14 of article 4 of the Federal law "About Contractual System in the field of Purchases of Goods, Works, Services for Ensuring the State and Municipal Needs".
