1. Approve the enclosed Rules of giving and consideration of the applications on issue of licenses for geological studying of subsoil.

2. To provide to committee of geology and subsurface use of the Ministry for Investments and Development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy on paper and electronically in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of actions, according to subitems 1), 2) and 3) this Item.

3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

Rules of giving and consideration of the applications on issue of licenses for geological studying of subsoil

Chapter 1. General provisions

1. These rules of giving and consideration of the applications on issue of licenses for geological studying of subsoil (further - Rules) are developed according to Item 6 of article 87 of the Code of the Republic of Kazakhstan of December 27, 2017 "About subsoil and subsurface use" (further - the Code) and determine procedure for giving and consideration of the applications on issue of licenses for geological studying of subsoil (further - the license).

Chapter 2. Procedure for filing of applications on issue of licenses for geological studying of subsoil

2. Person interested in receipt of the license (further - the applicant), submits to authorized body on studying of subsoil (further - authorized body) the written application in the form approved according to item 4 of article 29 of the Code.

3. The documents, stipulated in Item 3 articles 86 of the Code which are drawn up taking into account requirements of item 4 of article 86 of the Code are enclosed to the application.

4. The moment of filing of application is determined date and time of receipt of the statement in authorized body and is subject to accounting in register of statements (further - the magazine), stored in office of authorized body.

5. In case of reception of an application the office of authorized body registers and assigns to the statement unique accounting number, specifies date and time (hours, minutes) of logging.

The arrived statement is registered at the time of giving.

6. The magazine contains:

1) unique accounting number of the statement;

2) surname, name, middle name (in the presence) or name of the applicant;

3) date and time (hours, minutes) of registration of a statement.

Chapter 3. Procedure for consideration of the applications on issue of licenses for geological studying of subsoil

7. The authorized body considers the application within ten working days from the date of its receipt and grants the license or refuses its issue.

8. The authorized body refuses licensing if the statement or documents attached to it do not conform to requirements, stipulated in Article 86 Codes about what to the applicant the motivated written answer goes.

9. In case of refusal in licensing the applicant repeatedly submits the application to authorized body according to the procedure, established by these rules.

11. The refusal in licensing is appealed by the applicant according to the legislation of the Republic of Kazakhstan no later than ten working days from the date of the notification on it of the applicant.
