About approval of Rules of confirmation of conformity to requirements of technical regulations, observance of prohibitions and restrictions on conditionally released goods regarding technical regulation

1. Approve the enclosed Rules of confirmation of conformity to requirements of technical regulations, observance of prohibitions and restrictions on conditionally released goods regarding technical regulation.
2. To provide to committee of technical regulation and metrology of the Ministry for Investments and Development of the Republic of Kazakhstan:
1) state registration of this joint order in the Ministry of Justice of the Republic of Kazakhstan;
2) within ten calendar days from the date of state registration of this joint order the direction it the copy on paper and electronically in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;
3) placement of this joint order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan;
4) within ten working days after state registration of this joint order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of actions, according to subitems 1), 2) and 3) this Item.
3. To impose control of execution of this joint order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.
4. This joint order becomes effective after ten calendar days after day of its first official publication.

1. These rules of confirmation of conformity to requirements of technical regulations, observance of prohibitions and restrictions on conditionally released goods regarding technical regulation (further – Rules) are developed according to Item 10 of article 202 of the Code of the Republic of Kazakhstan "About customs regulation in the Republic of Kazakhstan" and determine procedure and terms of confirmation of conformity to requirements of technical regulations, observance of prohibitions and restrictions on conditionally released goods regarding technical regulation.
2. Under conditional release the following goods declared to the room under customs procedure of release for internal consumption which on registration date of the declaration on goods have no documents confirming compliance of goods to requirements of technical regulations are located:
products (goods) which are in the single list of products which are subject to obligatory assessment (confirmation) of compliance within the Customs union with issue of single documents, the approved decision of the Commission of custom union of April 7, 2011 to No. 620 "About the Single list of products which are subject to obligatory assessment (confirmation) of compliance within the Customs union with issue of single documents";
goods to which requirements of technical regulations of the Eurasian Economic Union extend;
goods to which requirements of technical regulations of the Republic of Kazakhstan extend.
3. For confirmation of conformity to requirements of technical regulations of conditionally released goods, the customs applicant submits the application for carrying out certification to bodies for confirmation of conformity and (or) test laboratories for form according to appendix 1 to the Rules of assessment of conformity approved by the order of the acting minister of trade and integration of the Republic of Kazakhstan of June 29, 2021 No. 433-HK "About approval of Rules of assessment of conformity" (it is registered in the Register of state registration of regulatory legal acts at No. 23364) (further – the Order).
By results of the procedure of confirmation of conformity to requirements of technical regulations of conditionally released goods bodies for confirmation of conformity make the decision on issue or on refusal in issue of the document on confirmation of conformity to requirements of technical regulations of conditionally released goods (further – the document).
In case of decision making about issue of the document bodies for confirmation of conformity issue the document according to item 4 of the Procedure for import to customs area of the Eurasian Economic Union of products which are subject to obligatory assessment of conformity on customs area of the Eurasian Economic Union approved by the decision of Council of the Eurasian economic commission of November 12, 2021 No. 130 "About procedure for import to customs area of the Eurasian Economic Union of products which are subject to obligatory assessment of conformity on customs area of the Eurasian Economic Union".
