1. Approve the enclosed Instruction for creation of the project of operation of space of subsoil.

2. To provide to committee of geology and subsurface use of the Ministry for Investments and Development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy on paper and electronically in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of actions, according to subitems 1), 2) and 3) this Item.

3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective since June 29, 2018 and is subject to official publication.

Instruction for creation of the project of operation of space of subsoil

Chapter 1. General provisions

1. This Instruction for creation of the project of operation of space of subsoil is developed according to Item 3 of article 257 of the Code of the Republic of Kazakhstan of December 27, 2017 "About subsoil and subsurface use" (further – the Code).

2. Space of subsoil is three-dimensional space property of subsoil which taking into account geotechnical, geological, economic and ecological factors can be used as environment for placement of objects of productive, scientific or other activity.

3. The project of operation of space of subsoil (further – the Project) is developed within the subsoil plot which is not containing the mineral deposit or containing insignificant resources of the minerals which are not popular minerals.

4. The site represents rectangle. If natural features or borders of other subsoil plot do not allow to determine the territory of the site of use of space of subsoil in the form of rectangle, the territory of such subsoil plot can have the form of quadrangle which two counter parties shall be parallel each other.

5. The project, and also its changes are subject to the state ecological and sanitary and epidemiologic examinations, and also approval of authorized body in the field of industrial safety, according to the procedure, established by articles 52 and 53 of the Code.

Chapter 2. Contents of the Project

6. The term of the Project cannot exceed twenty five consecutive years.

7. The project contains:

1) general characteristic of subjects to burial of hazardous, toxic agents, solid and liquid waste, places of dumping of waste and industrial waters, including location of object, period of operation, charge, availability and arrangement of the supervisory network of monitoring of underground waters, environment and subsoil;

2) the characteristic of object of underground construction, the characteristic of its isolation, type of rocks, depth and effective capacity of layer of collector, its area, porosity coefficient, the characteristic of the spreading and blocking water emphasis, speed of natural flow of underground waters, qualitative and quantitative indices, mining, special engineering-geological, hydrogeological and ecological conditions of burial, warehousing and dumping;

3) data on the organizations which activities attract formation of hazardous, toxic agents, solid and liquid waste, waste and industrial waters;

4) the characteristic of hazardous, toxic agents, solid and liquid waste, waste industrial waters with indication of the name of product, technical production or process in which it is formed, its physical characteristic, complete chemical composition, content of toxic components, fire danger, potential of explosion, solubility, compatibility with other substances in case of storage of the main contaminating radionuclides, their activities, and also the characteristic of transportation system;

5) actions for accomplishment of the recommendations containing in protocols of earlier carried out state examination and other bodies considering materials of exploration and other works on this object;

6) schedule of storage and (or) burial of solid, liquid and radioactive waste, hazardous toxic agents, dumping (downloading) of waste, industrial and technical waters;

8. The project, includes the relevant technical solutions which are followed by the corresponding graphical documentation.

9. The project determines special complex of actions for protection of subsoil and the environment, monitoring of underground and surface water, production and environmental monitoring.
