About approval of the Regulations on procedure for issue of the registration certificate for work with precious metals and gemstones

According to resolutions of the President of the Republic of Uzbekistan of February 1, 2017 "About additional measures for enhancement of mechanisms of rendering the state services to subjects of entrepreneurship" and of August 10, 2017 No. PP-3199 "About measures for the state support of the jewelry industry" the Cabinet of Ministers decides No. PP-2750:

1. Approve:

Regulations on procedure for issue of the registration certificate for work with precious metals and gemstones according to appendix No. 1;

The list of works with precious metals and gemstones (within groups of types of activity) on which implementation registration certificates, according to appendix No. 2 are issued;

The list of types of trade in jewelry and other products from precious metals and gemstones on which implementation registration certificates, according to appendix No. 3 are issued;

The scheme of interdepartmental electronic interaction in case of issue of the registration certificate for work with precious metals and gemstones according to appendix No. 4.

2. Determine that:

a) registration certificates for work with precious metals and gemstones (further - the registration certificate) are issued by the State assay chamber of the Agency on precious metals under the Central bank of the Republic of Uzbekistan (further - Assay chamber) only through the centers of the state services or the Single portal of interactive state services of the Republic of Uzbekistan;

b) the registration certificates which are earlier issued by Assay chamber for work with precious metals and gemstones are subject to renewal till June 10, 2018, and after the specified term are recognized invalid, except for issued electronically in 2018.

3. Recognize voided since June 1, 2018 some decisions of the Government of the Republic of Uzbekistan according to appendix No. 5.

4. To assay chamber:

since June 1, 2018 to provide issue of registration certificates for work with precious metals and gemstones according to this resolution;

in a month together with the interested ministries and departments to bring the regulatory legal acts which are earlier adopted by them into accord with this resolution.

5. To impose control of execution of this resolution on the deputy prime minister of the Republic of Uzbekistan - the Minister of Finance of the Republic of Uzbekistan D. A. Kuchkarov and the CEO of the Agency on precious metals in case of the Central bank of the Republic of Uzbekistan B. B. Sobirov.

Regulations on procedure for issue of the registration certificate for work with precious metals and gemstones

Chapter 1. General provisions

1. This Provision determines procedure for issue of the registration certificate on performance of works with precious metals and gemstones (further - the registration certificate).

2. In this Provision the following basic concepts are applied:

the registration certificate - the document granting the right to legal entities on implementation of works with precious metals and gemstones, trade in the jewelry certified by gemstones (further - gemstones) and semiprecious stones the containing matrix bar code (further - QR code) certifying the fact of entering of registration data into the register of the corresponding information system;

the applicant - the legal entity or person authorized by him in accordance with the established procedure filing the corresponding petition for issue of the registration certificate in the centers of the state services or the Single portal of interactive state services of the Republic of Uzbekistan (further - the Single portal).

the certified gemstones - the gemstones from above 0, carat which underwent certification in the independent homological center (laboratory) and having the corresponding confirmation of quality (the homological certificate) issued in accordance with the established procedure as a sign of guarantee of authenticity and quality of gemstone, containing information on group of color, purity, quality of facet and polishing, weight and other features of stone.

3. Issue of the registration certificate is performed only through the centers of the state services or the Single portal.

4. The registration certificate is issued by the State assay chamber under the Ministry of Finance of the Republic of Uzbekistan (further - Assay chamber) on implementation:

works with precious metals and gemstones for a period of five years according to the scheme according to appendix No. 1 to this Provision;

trade in jewelry and other products from precious metals and gemstones (further - jewelry), precious and semiprecious stones for a period of one year - generally or accelerated procedures according to schemes according to appendices No. 2 and 2a to this Provision.

5. Legal entities, irrespective of form of business, the extracting, overworking, processing, applying precious metals and gemstones in the production, scientific, military, educational and welfare purposes implementing (including with use is information - telecommunication technologies) rendering the intermediary services in trade (including with use is information - telecommunication technologies) which are buying up accepting as a deposit engaged in assessment, storage, exhibiting specified values, various objects containing them, procurement and conversion of scrap and waste of precious metals and gemstones, and also the military units, forming, divisions, the organizations and organizations subordinated to the Ministry of Defence, the Ministry of Internal Affairs of the Republic of Uzbekistan, the State committee of the Republic of Uzbekistan on defense industry are subject to registration in Assay chamber, to other ministries and departments making utilization of military technical means for the purpose of extraction of the nodes and details containing precious metals and gemstones for their further sending to processing enterprises.

If the work types specified in paragraph one of this Item are performed by one or several structural divisions of the organization which do not have the status of the legal entity, the organization under which supervision these structural divisions are is subject to registration. At the same time the registration certificate is drawn up on the organization - the legal entity also is issued separately for each structural division, with indication of details of the relevant division.

6. The legal entities using are not subject to registration in Assay chamber:

nitrate silver for analyses, precious metals as a part of the acquired equipments, devices, the electronic equipment, medical equipment, office equipment, puskoreguliruyushchy devices and automatic equipment, in the components, nodes and details (except for again acquired, containing precious metals in the structure spare parts, components, nodes and details to the equipments acquired earlier, devices, medical equipment, puskoreguliruyushchy devices and automatic equipment) applying argentiferous photosensitive materials, and also film photox-ray film, film photox-ray plates and similar materials - the film copy companies and film studios.

7. The registration certificate is issued on implementation of the certain works (within groups of types of activity or their parts) provided by appendices No. 2 and 3 to the resolution of the Cabinet of Ministers of the Republic of Uzbekistan of May 29, 2018 No. 399, within one group of work types.

In case of desire of the applicant to carry out the works provided by various groups of types of activity, the registration certificate is drawn up separately on each group of types of activity.

8. The registration certificate is drawn up in form according to appendix No. 3 to this Provision and includes QR - code which contains and allows to obtain when reading by the corresponding software and hardware the main information on the applicant (the data containing in the certificate on state registration) identifying it including the address reference on the Internet specifying entry in the register of the corresponding information system.

9. The chief of Assay chamber bears the personal responsibility for reliability and timely introduction of information on the registration certificates issued, renewed, extended, suspended, renewed and stopped by action in the corresponding information systems.

Chapter 2. Allowing requirements and conditions

10. Allowing requirements and conditions in case of the admission to implementation of the works with precious metals and gemstones provided by appendices to the resolution of the Cabinet of Ministers of the Republic of Uzbekistan of May 29, 2018 No. 399, are:

availability at the applicant belonging to it on the property right or other corporeal right of buildings and constructions, the floor spaces conforming to the established requirements when implementing works with precious metals and gemstones;

observance of requirements of fire safety, health regulations, regulations and hygienic standard rates, technical reinforcement and rules of safety of materials, raw materials, finished products in places of activities;

availability of the material and technical resources, equipment and other technical means necessary for implementation of works with precious metals.

11. Additional allowing requirements and conditions in case of the admission to implementation of works with precious metals and gemstones within groups of types of activity are:

a) when implementing lombard, microcredit and estimative activities:

availability at the applicant of the license for the right of implementation of the corresponding type of activity, observance of licensed requirements;

availability of the specifications and technical documentation regulating requirements to work with precious metals and gemstones according to groups of types of activity on which the registration certificate is drawn up;

b) during the work with the raw materials containing in the structure precious metals, use of precious metals and gemstones in the production purposes, use of precious metals in military equipment and/or aircraft:

availability of the specifications and technical documentation regulating requirements to work with precious metals and gemstones;

obligatory observance by the applicant of requirements of the operating procedure for obtaining, expenditure, accounting and storage of precious metals and gemstones, observance of procedure for preparation, packaging, transportation, conditions of acceptance delivery of scrap and waste of precious metals on processing enterprises;

obligatory submission by the applicant of reports on movement of precious metals and gemstones in forms and in the terms determined by Assay chamber;

c) during the work with the equipment containing precious metals and gemstones in the structure:

availability of the specifications and technical documentation regulating requirements to work with the equipment containing precious metals and gemstones in the structure;

obligatory observance by the applicant of requirements of the operating procedure for obtaining, expenditure, accounting and storage of precious metals and gemstones, observance of procedure for preparation, packaging, transportation, conditions of acceptance delivery of scrap and waste of precious metals on processing enterprises;

d) when using precious metals and gemstones in the welfare purposes:

availability of the specifications and technical documentation regulating requirements regarding use of precious metals and gemstones in the welfare purposes;

obligatory observance by the applicant of requirements of the operating procedure for obtaining, accounting and storage of precious metals and gemstones;

e) in case of occupation trade in jewelry from precious metals and gemstones, precious and semiprecious stones:

availability of the specifications and technical documentation regulating requirements to trade in jewelry, precious and semiprecious stones;

observance of established procedure of realization of jewelry, precious and semiprecious stones, requirements for ensuring their safety, accounting and storage;

maintaining the electronic register of the received and realized jewelry.

Chapter 3. Documents necessary for receipt of the registration certificate

12. For receipt of the registration certificate on implementation of the works (within groups of types of activity) provided by appendix No. 2 to the resolution of the Cabinet of Ministers of the Republic of Uzbekistan of May 29, 2018 No. 399, the applicant submits according to the procedure, established by the legislation, to the Center of the state services yavochno or through the Single portal electronically confirmed with the digital signature (further - the EDS) the statement for issue of the registration certificate in form according to appendix No. 4 to this Provision, with indication of:

the name and form of business of the legal entity, the identification taxpayer number (ITN), the place of its finding (postal address), the place of implementation of activities (address), names of division of bank and bank account number, phone number, e-mail addresses, the website - in the presence;

type(s) of works (or their parts) which the applicant intends to perform;

data on checking of scales and weights (weights);

data on compliance to requirements of fire safety of object in which implementation of works with precious metals and gemstones is supposed;

data on technical reinforcement and connection of object to the Center (Item) of technical protection of divisions of Head department of protection of National guard of the Republic of Uzbekistan - for objects in which it is supposed to use the precious metals emitted from reserves of the Central bank of the Republic of Uzbekistan;

the data confirming payment of collection for consideration of the application and collection for issue of the registration certificate.
