According to the subitem 4) of Item 2 of Article 2 and item 4 of article 16 of the Code of the Republic of Kazakhstan "About customs regulation in the Republic of Kazakhstan" I ORDER:

1. Approve:

1) Rules of creation, categorization, classification of arrangement and material equipment of customs, customs posts and check-points in the part which is not settled by the customs legislation of the Eurasian Economic Union according to appendix 1 to this order;

2) polozhennost regulations to arrangement and material equipping of customs, customs posts and check-points according to appendix 2 to this order;

3) standard requirements to arrangement and material equipment of customs, customs posts and check-points according to appendix 3 to this order;

4) requirements to arrangement and hardware of the elements of customs infrastructure located in locations of bodies of the state revenues and specialized public institutions which are a part of the system of bodies of state revenues and in other places in the territory of which customs transactions can be made and customs control, according to appendix 4 to this order can be carried out.

2. Declare invalid the order of the Minister of Finance of the Republic of Kazakhstan of March 26, 2015 No. 205 "About approval of Rules of creation, categorization, classification, and also regulations of polozhennost and standard requirements to arrangement and material equipment of customs, customs posts and check-points of the Republic of Kazakhstan" (it is registered in the Register of state registration of regulatory legal acts at No. 10811, it is published on May 13, 2015 in information system of law of Ad_let).

3. To committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan (Tengebayev A. M.) in the procedure established by the legislation to provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" of the Ministry of Justice of the Republic of Kazakhstan for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Finance of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of creation, categorization, classification of arrangement and material equipment of customs, customs posts and check-points in the part which is not settled by the customs legislation of the Eurasian Economic Union

Chapter 1. General provisions

1. These rules of creation, categorization, classification of arrangement and material equipment of customs, customs posts and check-points in the part which is not settled by the customs legislation of the Eurasian Economic Union are developed according to the subitem 4) of Item 2 of article 2 of the Code of the Republic of Kazakhstan "About customs regulation in the Republic of Kazakhstan" and determine procedure for creation, categorization, classification of arrangement and material equipment of customs, customs posts and check-points in the part which is not settled by the customs legislation of the Eurasian Economic Union.

Chapter 2. Procedure for creation of customs, customs posts and check-points

1) data on the planned amounts of the external economic transactions which are subject to customs control and declaring;

2) calculation and reasons for funds for designing, construction and content of infrastructure (objects) of customs posts, and also their equipment, hardware, creation and development of transport, engineering and social infrastructure necessary for the organization of the state control, in cases when designing, the construction and content is performed at the expense of means of the republican budget;

3) scheme of placement of infrastructure facilities of the customs post necessary for the organization of customs declaring and customs control;

4) offers on withdrawal of the parcel of land on which placement of objects of customs posts in cases when designing, the construction and content is performed at the expense of means of the republican budget is supposed.
