1. Approve the enclosed Rules of forming of lists of purchase of medicines and products of medical appointment within the guaranteed amount of free medical care and in system of compulsory social medical insurance.

2. To provide to committee of pharmacy of the Ministry of Health of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions;

4) placement of this order on Internet resource of the Ministry of Health of the Republic of Kazakhstan after official publication;

5) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Health of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2), 3) and 4) of this Item.

3. To impose control of execution of this order on the vice-Minister of Health of the Republic of Kazakhstan Tsoi A. V.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of forming of the list of purchase of medicines and products of medical appointment within the guaranteed amount of free medical care and in system of compulsory social medical insurance

Chapter 1. General provisions

1. These rules of forming of the list of purchase of medicines and products of medical appointment within the guaranteed amount of free medical care and in system of compulsory social medical insurance (further - Rules) are developed according to subitem 83-1) of Item 1 of article 7 of the Code of the Republic of Kazakhstan of September 18, 2009 "About health of the people and health care system" (further - the Code) and determine procedure for forming of the list of purchase of medicines and products of medical appointment within the guaranteed amount of free medical care and in system of compulsory social medical insurance (further - the List).

2. In Rules the following concepts are used:

1) medicine - the means representing or containing pharmacological the active agents coming into contact with human body or getting into its bodies and fabrics intended for prevention, diagnostics and treatment of diseases, and also change of condition and functions of organism: medicinal substance, medicinal raw materials, balk-products of medicines, medicines;

2) efficiency of medicines, products of medical appointment and medical equipment - set of the characteristics providing achievement of preventive, diagnostic, medical and (or) rehabilitation effects;

3)  No. KR DSM-23 is excluded according to the Order of the Minister of Health of the Republic of Kazakhstan of 06.10.2018;

4) authorized body in the field of health care (further - authorized body) - the state body performing management in the field of protection of public health, medical and pharmaceutical science, medical and pharmaceutical education, drug circulation, products of medical appointment and medical equipment, control of quality of medical services;

5) the Kazakhstan national medicinal form - the list of medicines with the proved clinical efficiency and safety containing information on medicines and the prices, which is obligatory basis for development of medicinal forms of the organizations of health care and forming of lists of purchase of medicines within the guaranteed amount of free medical care and in system of compulsory social medical insurance;

6) products of medical appointment - the products and materials used for holding preventive, diagnostic and medical actions: the medical tools, dental, consumable, dressing and sutural materials fixing bandages and devices, products of medical optics;

7)  No. KR DSM-23 is excluded according to the Order of the Minister of Health of the Republic of Kazakhstan of 06.10.2018;

8) compulsory social medical insurance - complex of legal, economic and organizational measures on delivery of health care to consumers of medical services for the asset account of fund of social medical insurance;

9) the guaranteed amount of free medical care - amount of the medical care provided at the expense of budgetary funds according to the list determined by the Government of the Republic of Kazakhstan, to citizens of the Republic of Kazakhstan, oralmans, and also the foreigners and persons without citizenship who are constantly living in the territory of the Republic of Kazakhstan;

10) the pharmakoekonomichesky analysis - assessment of results (consequences) and cost (costs) of the researched technologies of treatment by medicine or product of medical appointment on the basis of carrying out the complex interconnected kliniko-economic analysis.
