1. Approve the enclosed Regulations on state commission on inventories of minerals of the Republic of Kazakhstan.

2. Recognize to invalid:

1) the subitem 1) Item 1 of the order of the Minister of investments and development of the Republic of Kazakhstan of April 21, 2015 No. 472 "About approval of regulations on the State Commission on Mineral Reserves of the Republic of Kazakhstan and the interregional commissions on inventories of minerals" (it is registered in the Register of state registration of regulatory legal acts for No. 11200, it is published of June 18, 2015 in information system of law of Ad_let);

2) the order of the Minister of investments and development of the Republic of Kazakhstan of July 5, 2016 No. 539 "About modification of the order of the Minister of investments and development of the Republic of Kazakhstan of April 21, 2015 No. 472 "About approval of regulations on the State Commission on Mineral Reserves of the Republic of Kazakhstan and the interregional commissions on inventories of minerals"" (registered in the Register of state registration of regulatory legal acts for No. 14173, it is published of September 9, 2016 in information system of law of Ad_let).

3. To provide to committee of geology and subsurface use of the Ministry for Investments and Development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy on paper and electronically in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan;

4) within ten working days after state registration of this order submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

4. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

5. This order becomes effective since June 29, 2018 and is effective till January 1, 2024.

Regulations on state commission on inventories of minerals of the Republic of Kazakhstan

Chapter 1. General provisions

1. This Regulations on state commission on inventories of minerals of the Republic of Kazakhstan (further - the Provision) are developed in compliance Item 5 of article 141 of the Code of the Republic of Kazakhstan "About subsoil and subsurface use" in edition according to Item 6 of article 277 of the specified Code and determine questions of the organization of activities of the State Commission on Mineral Reserves of the Republic of Kazakhstan (further - the Commission), its structure, the regulations of work and record keeping.

2. The commission is created under department of authorized body on studying of subsoil and is collegiate organ, performing state examination of subsoil on hydrocarbons and solid minerals except for of popular minerals (further - examination).

Chapter 2. Organization of activities of the Commission

5. The main objective of the Commission is conducting examination. When conducting examination the Commission determines:

1) accuracy of the data about quantity, quality, structure, technological properties of inventories of minerals, and also features of subsoil;

2) completeness and reliability of geological, mining, hydrogeological, engineering-geological, ecological and technical and economic data for conditions of mining;

3) feasibility statements on cost efficiency of development of fields, extraction coefficients on hydrocarbons, conclusions and offers on expansion of mineral resources, degree of readiness of inventories and subsoil plots for use;

4) results and quality of estimative, prospecting and operational works, and also works on geological studying and assessment of subsoil;

5) justification of liquidation or preservation of mineral deposits, write-offs of inventories of the minerals which lost industrial value, inexpedient to working off for the technical and economic or mining reasons, exceeding normative errors not of confirmation during the subsequent exploration works and working off.

6. The commission in the activities performs the following functions:

1) is issued by the conclusion about profitability of explored reserves of minerals which is the basis for their statement on the state stock balance of minerals;

2) gives geological economic evaluation of inventories and forecast resources of minerals according to accounting of market economy and environment of mineral raw materials;

3) confirms the fact of commercial detection as a result of investigation in the contract area.

7. During examination the Commission:

Requests 1) and receives from the central state and local executive bodies subordinated to authorized body on studying of subsoil of the organizations and organizations, and from subsoil users information, documents and materials necessary for accomplishment of the task assigned to them;

2) attracts independent experts;

3) holds as necessary field meetings on ekspertiruyemy objects;
