About obligatory legal examination of technical regulatory legal acts

1. Approve the Instruction about procedure of obligatory legal examination of technical regulatory legal acts it (is applied).
1-1. Determine that:
1-1.1. in case of acceptance by the state bodies realizing state policy in the military sphere, the sphere of protection of the state secrets and other information of limited distribution in the field of use of atomic energy, ensuring nuclear and radiation safety, telecommunication (further - authorized bodies), the act of the legislation establishing obligation of the observance by legal entities and individual entrepreneurs of technical codes of common practice, state standards of the Republic of Belarus in the respective sphere (area), such technical codes of common practice and state standards of the Republic of Belarus no later than three working days from the date of following behind day of adoption of the act of the legislation establishing their obligation of observance by legal entities and individual entrepreneurs go authorized body to the National center of legal information for conducting their obligatory legal examination. If such act of the legislation is adopted by the state body which was not accepting (not publishing) the corresponding technical regulatory legal acts (further, unless otherwise specified, - technical acts), their direction is performed accepted (published) them state bodies no later than three working days after obtaining from the authorized body which adopted the act of the legislation, the notification on need of the direction for obligatory legal examination of such technical acts;
1-1.2. no later than three working days from the date of receipt of the positive conclusion (the last positive conclusion) by results of conducting obligatory legal examination of the technical act (technical acts) concerning which (which) the act of the legislation specified in subitem 1-1.1 of this Item establishes obligation of observance by legal entities and individual entrepreneurs authorized bodies send the act of the legislation to the Ministry of Justice for conducting obligatory legal examination according to the procedure, established by the Instruction about procedure of the obligatory legal examination of regulatory legal acts approved by the resolution of Council of Ministers of the Republic of Belarus of September 23, 2006 No. 1244, with appendix of the positive conclusion (the positive conclusions) which is taken out (taken out) by results of obligatory legal examination of the technical act (technical acts);
1-1.3. non-presentation of one or several documents specified in subitem 1-1.2 of this Item is the basis for return of the act of the legislation by the Ministry of Justice to authorized body without conducting obligatory legal examination;
