1. Approve the enclosed Non-discriminatory method of calculation of rates (the prices, rates of charges) or their limits on regulated services (goods, works) of water supply and (or) water disposal.

2. Declare invalid the order of the Chairman of the Agency of the Republic of Kazakhstan on regulation of natural monopolies of October 1, 2013 297-OD "About approval of the Method of calculation of the differential tariffs on regulated services of water supply and (or) water disposal" (registered in the Register of state registration of regulatory legal acts of the Republic of Kazakhstan for No. 8886, No. 77 published in the Kazakhstanskaya Pravda newspaper of April 22, 2014 (27698).

3. To committee on regulation of natural monopolies, protection of the competition and the rights of consumers of the Ministry of national economy of the Republic of Kazakhstan to provide in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of national economy of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of national economy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

4. To impose control of execution of this order on the supervising vice-minister of national economy of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

Non-discriminatory method of calculation of rates (the prices, rates of charges) or their limits on regulated services (goods, works) of water supply and (or) water disposals

Chapter 1. General provisions

1. This Non-discriminatory method of calculation of rates (the prices, rates of charges) or their limits on regulated services (goods, works) of water supply and (or) water disposal (further – the Technique) is developed according to the subitem 4) of Item 1 of article 13 of the Law of the Republic of Kazakhstan of July 9, 1998 "About natural monopolies" (further – the Law), the Special procedure for forming of costs, No. 130-OD applied in case of approval of rates (the prices, rates of charges) on regulated services (goods, works) of subjects of natural monopolies, the approved order of the Chairman of the Agency of the Republic of Kazakhstan on regulation of natural monopolies of April 25, 2013 (it is registered in the Register of state registration of regulatory legal acts for No. 8480) (further – the Special procedure) and determines calculation of rates (the prices, rates of charges) or their limits on regulated services (goods, works) of water supply and (or) water disposal.

2. The principles of the Technique are:

1) stimulation of consumers to economical use of drinking water and application of resource-saving technologies;

2) cost recovery, the services of water supply and (or) water disposal connected with rendering.

3. In this Technique the following concepts are used:

the water management organizations – legal entities whose activities are connected with regulation, delivery, reproduction of waters, water supply, water disposal and operation of water objects;

water supply – set of the actions providing fence, storage, preparation, giving and distribution of water through water supply systems to water consumers;

water disposal – set of the actions providing collection, transportation, cleaning and removal of sewage through systems of water disposal in water objects and (or) on land relief;

costly part of rate (the price, rate of charge) – set of the costs connected with rendering services (works) by the subject of natural monopoly which are considered in case of approval of rate (the price, rate of charge) and the tariff estimates consisting of production expenses and expenses of the period.

Other concepts and terms used in this Technique are applied according to the Law and the Water code of the Republic of Kazakhstan of July 9, 2003.

4. Forming of rates (the prices, rates of charges) is performed based on separate accounting of the income, costs and the involved assets by each type of regulated services (goods, works).

When forming the differential tariffs on services of water supply and (or) water disposal costs taking into account requirements of the Special procedure join.

In case of differentiation of rates for services of water supply and water disposal rates for customer groups are determined by customer groups taking into account:

cost recoveries, services of water supply and (or) water disposal connected with rendering;

level of solvency of the population of the respective region;

influences on inflation;

structures of consumption of water supply and water disposal;

level of development of subjects of entrepreneurship.

Chapter 2. Procedure for determination of customer groups

5. For the purpose of establishment of the differential tariffs, consumers are subdivided into the following groups:

1 group:

physical persons (population).

2 group:

the companies which are engaged in production of heat energy within water consumption amounts for own needs in production process of heat energy and amounts of feed when rendering services of hot water supply (in case of open hot water supply);
