1. Approve the enclosed Regulations on licensing of activities of legal entities, individual entrepreneurs on the right of performance of works on quarantine phytosanitary disinfecting.

2. Realization of the powers provided by this resolution is performed by Federal Service for Veterinary and Phytosanitary Surveillance within the number of her workers and budgetary appropriations provided by it in the federal budget on management and management in the field of the established functions established by the Government of the limiting Russian Federation.

3. This resolution becomes effective since January 1, 2018.

Regulations on licensing of activities of legal entities, individual entrepreneurs on the right of performance of works on quarantine phytosanitary disinfecting

1. This Provision establishes procedure for licensing of activities of legal entities, individual entrepreneurs on the right of performance of works on quarantine phytosanitary disinfecting (further respectively - works on disinfecting, the licensed type of activity).

2. The licensed type of activity includes accomplishment of the work types on disinfecting provided by the list established by the order of the Government of the Russian Federation of August 9, 2016 No. 768 "About establishment of work types on quarantine phytosanitary disinfecting" (further - the list).

3. Licensing of activities of legal entities, individual entrepreneurs on the right of performance of works on disinfecting is performed by Federal Service for Veterinary and Phytosanitary Surveillance (further - the licensing body).

4. The licensed requirements imposed to the legal entity (individual entrepreneur) who filed in the licensing body petition for provision of the license for the right of performance of works for disinfecting (further - the license applicant), are:

a) availability at the license applicant of the rooms, buildings, constructions and other objects which are not objects of housing stock and belonging to it on the property right or other legal cause conforming to the established requirements and the necessary for accomplishment declared works on disinfecting;

b) availability at the license applicant belonging to it on the property right or other legal cause of devices and control systems, alarm systems, notifications and the protection conforming to the established requirements and the necessary for accomplishment declared works on disinfecting.

5. For performance of works on disinfecting, established by Items 1 and 2 of the list, the following licensed requirements are imposed to the license applicant except the requirements specified in item 4 of this provision:

a) availability of the individual protection equipment conforming to the established requirements;

b) when using the pesticides in gaseous state which are in vessels under excessive pressure - availability of the workers who signed employment contracts with the license applicant, certified in the field of industrial safety of hazardous production facilities according to federal regulations and rules of industrial safety;

c) availability of the skilled workers who signed employment contracts with the license applicant, directly performing works on disinfecting, having higher education or secondary vocational professional education and length of service at least 3 years on the corresponding specialty (agronomics, protection of plants) in the field of implementation of the licensed type of activity;

d) availability of system of production supervision of works on transportation and utilization of pesticides, including magazines of storage, transportation and utilization of pesticides;

e) civil responsibility insurance in the cases established by the Federal Law "About Obligatory Civil Liability Insurance of the Owner of Dangerous Object for Damnification as a result of Accident on Dangerous Object";

e) availability of actions plans on localization and mitigation of consequences of accidents on objects of disinfecting according to the Federal Law "About Industrial Safety of Hazardous Production Facilities";

g) availability at the license applicant belonging to it on the property right or other legitimate right of the specialized vehicles meeting the requirements established by the European agreement on the international road delivery of dangerous goods of September 30, 1957 (DOPOG), or the agreement with the specialized organization on provision of the transport services meeting the established requirements.

6. For carrying out work on disinfecting, stipulated in Item the 7th list, requirement for availability of license for activities in the field of use of the sources of ionizing radiation (generating) except for of case is imposed to the license applicant except the requirements specified in item 4 of this provision if these sources are used in medical activities.

7. Licensed requirements to the legal entity (individual entrepreneur) having the license for the right of performance of works on disinfecting (further - the licensee), except the requirements specified in items 4 - the 6th this provision, are:

a) observance of requirements to the methods and methods of quarantine phytosanitary disinfecting providing quality of performance of works on disinfecting and procedure for registration of their results established by Federal Service for Veterinary and Phytosanitary Surveillance;

b) accomplishment of quarantine phytosanitary requirements of the importing country regarding quarantine phytosanitary disinfecting.

8. Violations of provisions of Item 7 of this provision and part 3 of article 27 of the Federal Law of July 21, 2014 No. 206-FZ "About quarantine of plants", the entailed effects established by part 11 of article 19 of the Federal law "About Licensing of Separate Types of Activity" belong to gross violations by the licensee of licensed requirements.
