About approval of the Regulations on features of procedure for provision by the serviceman, to law enforcement officers and members of their families of the state premises and uses of them

For the purpose of streamlining of housing providing the military personnel, law enforcement officers and members of their families, according to article 57 of the Housing code of the Kyrgyz Republic, article 12 of the Law of the Kyrgyz Republic "About the status of the military personnel", article 72 of the Law of the Kyrgyz Republic "About service in law enforcement agencies of the Kyrgyz Republic", being guided by articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic", the Cabinet of Ministers of the Kyrgyz Republic decides:

1. Approve Regulations on features of procedure for provision by the serviceman, to law enforcement officers and members of their families of the state premises and uses by them according to appendix.

2. To perform the expenses connected with implementation of this resolution within means of the state bodies approved for the corresponding year.

3. This resolution becomes effective after ten days from the date of official publication.

4. To impose control of execution of this resolution on department of defense, law and order and emergency situations of Government office of the Kyrgyz Republic.

Regulations on features of procedure for provision by the serviceman, to law enforcement officers and members of their families of the state premises and uses of them

1. General provisions

1. The main terms used in Regulations on features of procedure for provision by the serviceman, to law enforcement officers (further - employees) and to members of their families of the state premises and uses of them (further - the Provision):

other important circumstances are the bases of dismissal of the military personnel/employees connected with election in representative bodies of the Kyrgyz Republic and election or position assignment of the judge;

departmental housing stock - set of the premises of the state housing stock which are under authority of state body including:

1) constructed at the expense of the budgetary funds and other sources which are not forbidden by the legislation of the Kyrgyz Republic, or transferred to the jurisdiction of the relevant state body according to the regulatory legal acts of the Kyrgyz Republic governing the housing relations;

2) acquired at physical persons and legal entities according to the regulatory legal acts of the Kyrgyz Republic governing the housing relations;

3) the re-equiped buildings and constructions suitable for use as premises;

length of service - set of terms of military service of faces of officers, the ensigns and the military personnel of contractual service, faces of the commanding and ordinary structure which are in the service in in law enforcement agencies;

the housing (household) commission - the permanent advisory body created for the purpose of objective, impartial and comprehensive consideration of questions of accounting of the military personnel/employees, members of their families and persons, dismissed from service for providing with premises, their removal from accounting, creation of priority and distribution of premises, and also questions of use of departmental housing stock of state body, its military units and organizations;

housing stock of military unit (organization) - component of the departmental housing stock located in the territory of military unit (organization) of state body and intended for accommodation of the military personnel/employees, workers and employees of this military unit (organization);

permanent premises - separate unit (the individual house, the apartment in the apartment house, the room in hostel/lodging house) departmental housing stock, and also allocated from the state housing stock (which is not relating to departmental housing stock), municipal housing stock, provided with furniture and telephone communication, intended for settling of certain officials for fulfillment of duties on positions which list is determined by the head of state body;

reserve of housing stock - set of premises in the amount of no more than 5 percent of housing stock intended for providing the military personnel/employees with premises according to the decision of the head of state body;

family members - the spouse, the spouse who are married, and minor children jointly living, and also full age children of the military personnel/employees jointly living in case of absence at them in property of housing.

2. Privatization of the premises provided to the military personnel/employees is allowed (except for the premises which are in the closed military camps and hostels/lodging houses, permanent premises, and also except for persons to whom premises or the parcel of land under construction of the individual apartment house in other settlement were provided earlier).

General actions for operation of departmental housing stock, ensuring its safety, control of observance of instructions for use by premises are performed by room and operational (economic) bodies of state body under which authority the departmental housing stock is (further - room and operational (economic) body).

Actions for operation of housing stock of military units (organizations) are performed by commanders (chiefs of organizations) of military units.

4. The procedure for activities of the housing commissions is determined by the head of state body according to Standard regulations on the housing (household) commissions (appendix 1 to this Provision).

5. The list of the closed military camps is determined by heads of state bodies under the authority of which there are such towns.
