About bases of the cultural legislation

Chapter 1. General provisions

Article 1. Tasks of the cultural legislation of the Republic of Armenia

Tasks of the cultural legislation of the Republic of Armenia are:

1) providing and protection of constitutional right of citizens of the Republic of Armenia on freedom of expression, creativity, participation in cultural life of society;

2) regulation of the relations arising between subjects of cultural activities;

3) determination of the principles of the state cultural policy, legal basis of the state support of culture and guarantee of non-interference of the state to creative process;

4) creation of legal guarantees of preserving, distribution and development of cultural richness of the Republic of Armenia.

Article 2. Forming of the state cultural policy

The state cultural policy in the Republic of Armenia is created on state (annual, three-year-old, perspective) to programs of preserving, distribution and cultural development which on representation of the Government of the Republic of Armenia affirm National Assembly of the Republic of Armenia in the form of the law.

Article 3. Principles of the state cultural policy

The basic principles of the state cultural policy are:

1) the state, public and democratic nature of management in the field of culture;

2) freedom of cultural and creative activities;

3) availability of cultural values to familiarizing with them;

4) priority of national cultural values of the international value;

5) independence of the cultural organizations.

Article 4. Purposes of the state cultural policy

The purposes of the state cultural policy are:

1) awareness of culture by society as development tools;

2) search of new values and new ideas;

3) creation of conditions for reproduction and development of creative capacity of society;

4) forming of civil society.

Article 5. Cultural legislation of the Republic of Armenia

The cultural legislation of the Republic of Armenia consists of the Constitution of the Republic of Armenia, this Law, other laws and legal acts.

If international treaties of the Republic of Armenia establish other regulations, than those which are provided by this Law then are applied regulations of international treaties.

Article 6. The basic concepts used in this Law

The basic concepts used in this Law make the following sense and content:

culture - set of conduct, feelings and thinking in material and spiritual spheres of public life and their valuable expression;

cultural activities - preserving, creation, distribution and interpretation of cultural values and objects (objects), presentation and realization of the cultural benefits;

cultural values - works of culture and art, art national creativity and crafts, folklore, ethical and esthetic ideals, regulations and examples of behavior, languages, dialects and dialects, national traditions and customs, historical and cultural toponyms, results and methods of scientific research of cultural activities, pieces (objects) of cultural heritage;

the cultural benefits - the cultural services rendered by legal entities and physical persons and the cultural products (goods) sold by them for the purpose of satisfaction of cultural requirements of the population;

the non-profit cultural organization - the organization which main objective of creation is implementation of cultural activities;

creative activities - creation and interpretation of cultural values;

the creative specialist - the physical person creating or interpreting cultural values;

the union of creative specialists - the voluntary consolidation of creative specialists having the status of public association and created according to the procedure, established by the legislation of the Republic of Armenia, on the basis of community of interests of creative specialists for satisfaction of spiritual or other non-material needs;

cultural heritage of the Republic Armenia - set of the cultural values created in the past which are important from the archaeological, architectural, historical, esthetic or welfare points of view for preserving and development of cultural identity of the Republic of Armenia and the Armenian people, its contribution to world civilization;

cultural property of the Republic of Armenia - set of the cultural values (including objects of cultural heritage) having national value for the Armenian people;

the state cultural policy - activities of the state in the field of culture and set of the principles and regulations by which the state when implementing state policy is guided.

Article 7. Coverages of this Law

Operation of this Law extends to spheres:

1) protection, studying, use and promoting of objects of cultural heritage (historical and cultural monuments);

2) motion picture arts and other types of audiovisual arts;

3) fiction, architecture, fine arts, design, photo, scenic, space, musical art and other types and genres of art;

4) art folk art and crafts, national culture;

5) amateur (amateur) art creativity;

6) protection, studying and promoting of museum pieces, museum meetings, antiquarian books, chronicles and other cultural values;

7) collectings of cultural values;

8) library, archive and publishing;

9) esthetic education and art education, pedagogical activities in the field of culture;

10) scientific activities in the field of cultural science and culture;

11) international cultural cooperation;

12) productions of the materials, equipment and other means of cultural appointment necessary for preserving, creations, distribution and interpretations (perception) of cultural values;

13) on other spheres of cultural activities.

Article 8. Attitude towards cultures of ethnic minorities

The Republic of Armenia promotes preserving and development of cultural identity of the ethnic minorities living in its territory, promotes creation of conditions for preserving, distribution and development of their religion, traditions, language, cultural heritage, culture by implementation of state programs.

Chapter 2. Basic rights and freedoms of man and citizen in the field of culture

Article 9. The participation right in cultural life and implementation of cultural activities

Participation in cultural life of society and implementation of cultural activities in the territory of the Republic of Armenia are the inalienable right of each person, irrespective of his nationality, race, floor, language, religion, beliefs, social origin, property or other status.

Article 10. Right to implementation of creative activities

Each person has the right to perform creative activities.
