About the measures for compensation for expenses connected with delivery to the Kyrgyz Republic of bodies of citizens of the Kyrgyz Republic, the dead abroad

1. Approve the Instruction about procedure for lump sum payment on expenses on repatriation of bodies of citizens of the Kyrgyz Republic, the dead abroad, according to appendix to this resolution.

2. Establish the amount of lump sum payment on expenses on repatriation of bodies of citizens of the Kyrgyz Republic, the dead abroad, in the amount of 500 minimum settlement indicators.

3. To the Ministry of Finance of the Kyrgyz Republic:

- in coordination with Committee on the budget and finance of Jogorku Kenesh of the Kyrgyz Republic to dig up additional resources in 10,0 amount (ten) million som for compensation for expenses, the bodies of citizens of the Kyrgyz Republic tied with delivery to the Kyrgyz Republic, the dead abroad, for the Information and consulting center of Public service of migration under the Government of the Kyrgyz Republic;

- provide corresponding changes by preparation of the bill "About introduction of amendments to the Law of the Kyrgyz Republic "About the republican budget of the Kyrgyz Republic for 2018 and the forecast for 2019-2020" and the next years following from this resolution.

4. Recognize invalid:

- the order of the Government of the Kyrgyz Republic "About compensation for expenses, the bodies of citizens of the Kyrgyz Republic tied with delivery home, the dead abroad, during implementation of labor activity by them" of June 30, 2007 No. 255;

- the order of the Government of the Kyrgyz Republic "About the further measures for implementation of compensation for expenses connected with delivery home of bodies of citizens of the Kyrgyz Republic, the dead abroad during implementation of labor activity by them" of February 11, 2011 No. 40;

- Items 1 and 2 of the order of the Government of the Kyrgyz Republic "About modification and amendments in some decisions of the Government of the Kyrgyz Republic" of December 3, 2012 No. 810;

- Items 1 and 2 of the order of the Government of the Kyrgyz Republic "About modification of some decisions of the Government of the Kyrgyz Republic" of August 6, 2014 No. 450.

5. To impose control of execution of this resolution on department of social development of Government office of the Kyrgyz Republic.

6. This resolution becomes effective after ten days from the date of official publication.

The instruction about procedure for lump sum payment on expenses on repatriation of bodies of citizens of the Kyrgyz Republic, the dead abroad

I. General provisions

1. This Instruction determines procedure for lump sum payment on expenses to the close relatives or persons performing costs for repatriation of bodies of citizens of the Kyrgyz Republic, the dead abroad.

2. Financing of the expenses connected with delivery to the Kyrgyz Republic of bodies of citizens of the Kyrgyz Republic, the dead abroad is made within the means provided to the Information and consulting center of Public service of migration under the Government of the Kyrgyz Republic (further - IKTs) for the corresponding year.

3. Lump sum payment on expenses on repatriation of bodies of citizens of the Kyrgyz Republic, the dead abroad (further - lump sum payment), is made in national currency of the Kyrgyz Republic in the territory of the Kyrgyz Republic, by transfer to the settlement account.

4. Foreign organizations of the Kyrgyz Republic render assistance of IKTs in confirmation of the fact of death of the citizen of the Kyrgyz Republic.

II. Right to lump sum payment

5. One close relative or person which performed the direct expenses connected with transportation to the Kyrgyz Republic of body of the citizen of the Kyrgyz Republic, the dead abroad has the right to lump sum payment (further - the receiver).

6. Only one person to who the documents confirming the fact of payment of expenses are processed can be the receiver.

7. On behalf of the receiver also the other person under the notarized power of attorney can receive payments.

8. The application for receipt of lump sum payment shall be submitted to IKTs no later than three months from the date of the death of the citizen of the Kyrgyz Republic.

8-1. During introduction and action of emergency mode and/or emergency rule in the territory of the Kyrgyz Republic or in its certain areas submission due date of the statement in IKTs is prolonged for receipt of lump sum payment before the termination of the mode.

The citizens who showed willingness to receive immediate compensation for the expenses connected with delivery of bodies of citizens of the Kyrgyz Republic shall submit the application to IKTs within two months from the date of cancellation of emergency mode and/or emergency rule in the territory of the Kyrgyz Republic or in its certain areas.

III. Procedure for the address of the receiver for receipt of lump sum payment

9. For receipt of lump sum payment the receiver submits the application addressed to the director of IKTs of form according to appendices 1 or 2 to this Instruction, with presentation of the passport.

10. The following documents are attached to the statement according to appendices 1 and 2:

1) if receiver is the close relative including when he is person which performed the direct expenses connected with transportation:

- passport copy of the receiver;

- copies of the documents confirming relationship (the marriage certficate, the certificate of birth);

- notarized copy of the death certificate;

2) if receiver is the person which performed the direct expenses connected with transportation, who is not the close relative of the dead:

- passport copy of the receiver;

- notarized copy of the death certificate;
