About approval of the Regulations on the organization of the cash address and conducting issued and cash transactions in bank system during the special period

According to Articles 7, of 15, "About the National Bank of Ukraine" and for the purpose of uninterrupted providing economy with cash in the conditions of the special period the Board of the National Bank of Ukraine decides 33 and 56 Laws of Ukraine:

1. Approve Regulations on the organization of the cash address and conducting issued and cash transactions in bank system during the special period which are applied.

2. Recognize invalid:

1) the resolution of Board of the National Bank of Ukraine of February 12, 2004 No. 46 "About approval of the Regulations on the organization of the cash address and conducting issued and cash transactions in bank system during the special period", registered in the Ministry of Justice of Ukraine on February 27, 2004 for No. 257/8856;

2) the resolution of Board of the National Bank of Ukraine of May 18, 2007 No. 189 "About modification of the Regulations on the organization of the cash address and conducting issued and cash transactions in bank system during the special period", registered in the Ministry of Justice of Ukraine on May 30, 2007 for No. 555/13822;

3) the resolution of Board of the National Bank of Ukraine of March 3, 2015 No. 157 "About modification of the Regulations on the organization of the cash address and conducting issued and cash transactions in bank system during the special period".

3. To department of currency circulation (Zayvenko V. P.) after official publication to inform banks of Ukraine information on adoption of this resolution.

4. To impose control over the implementation of this resolution on the Chairman of the National Bank of Ukraine Smoliya Ya. V.

5. The resolution becomes effective from the date of, its official publication following behind day.

Regulations on the organization of the cash address and conducting issued and cash transactions in bank system during the special period

I. General provisions

1. This Provision is developed according to requirements of the Constitution of Ukraine, the Laws of Ukraine "About defense of Ukraine", "About legal regime of warlike situation", "About the National Bank of Ukraine", other legal acts of Ukraine and regulatory legal acts of the National Bank of Ukraine (further - National Bank) which regulate the organization of work of bank system during the special period and in the extraordinary mode, work of banks on the organization of the cash address and conducting issued and cash transactions in bank system and cash transactions of subjects of managing.

2. The purpose of development of this provision is ensuring stable work of bank system of Ukraine with cash in the conditions of the special period and uninterrupted providing economy with cash, and also ensuring connections with in cash, military units, divisions of the Armed Forces of Ukraine, National guard of Ukraine (further - military forming), National police of Ukraine, the Security Service of Ukraine, Administration of the State Border Service of Ukraine (further - law enforcement agencies), Administrations of Public service of special communication and information security of Ukraine (further - Gosspetssvyaz).

3. This Provision determines the main requirements to the organization of work with cash of divisions of National Bank [Operations department (further - the division of National Bank responsible for operating activiies), Department of currency circulation, inclusive with management of numismatical products and cash transactions (further - the division of National Bank responsible for money turnover), departments of currency circulation in regions of Department of currency circulation of National Bank (further - divisions of currency circulation in regions), the Central storage (further - the division of National Bank responsible for storage and transportation of values)], and also banks on which the Board of National Bank made the decision on provision of powers by it on stock holding of cash of National Bank and carrying out transactions with them (further - authorized banks), and banks, representatives for work (implementation of transactions) during the special period (further together - the attracted banks). From the date of approach of the special period other normative and legal and administrative acts of National Bank are effective in the parts which are not contradicting this Provision.

Divisions of National Bank, authorized banks and banks shall be guided by this provision or its separate regulations in case of work in the conditions of the extraordinary mode.

Division managers of National Bank, authorized banks and banks from the date of the announcement of the special period in case of situation which threatens proper storage of values in the certain region in time off, days off and holidays have the right to make the decision about their export in other division of bank with documentary registration of such transaction and the notification of National Bank no later than the next working day.

Divisions of National Bank, the attracted banks in case of introduction of warlike situation perform the activities provided by requirements of this provision taking into account requirements of the normative and legal and administrative acts adopted by the President of Ukraine, the Verkhovna Rada of Ukraine, the National Security and Defense Council of Ukraine and based on separate board decisions of National Bank.

4. Division managers of National Bank, the attracted banks have the right to determine the action plan and/or to make the decision for ensuring work of division / the attracted bank depending on the circumstances which arose during the special period.

The attracted banks have the right to create the special commissions for development and taking measures to providing the organization of work, determination of procedure for internal bank procedures of implementation of transactions during the special period.
