About measures for the organization of activities of Inspectorate for control of agro-industrial complex and ensuring food security under the Prosecutor General's Office of the Republic of Uzbekistan

For the purpose of radical enhancement of the control system in the field of agricultural industry, food security and water consumption, and also the effective organization of activities of Inspectorate for control of agro-industrial complex and ensuring food security under the Prosecutor General's Office of the Republic of Uzbekistan:

1. Take into consideration that according to the Presidential decree of the Republic of Uzbekistan of April 17, 2018 No. UP-5418 "About Measures for Radical Enhancement of System of Public Administration by Agricultural and Water Economy":

the Inspectorate for control of agro-industrial complex and ensuring food security under the Prosecutor General's Office of the Republic of Uzbekistan is formed (further - Inspection);

since August 1, 2018 are abolished the State grain inspection under the Cabinet of Ministers of the Republic of Uzbekistan, the Main state inspectorate for supervision of technical condition of machines and the equipment, the Main state inspectorate for breeding case in livestock production, Republican water inspection Uzsuvnazorat, the State center for certification and quality control of seeds of crops Uzdavurugnazoratmarkaz.

2. Abolish since August 1, 2018 the State company "The Uzbek center of certification of cotton products Sifat of the Uzstandart Agency.

3. Determine that:

Inspection is legal successor of the abolished organizations for their rights, obligations and agreements;

tasks, functions and the powers of the abolished organizations provided by acts of the legislation are transferred to Inspection.

To render the ministry of employment and employment relationships of the Republic of Uzbekistan assistance in employment of employees of the abolished organizations.

4. The main objectives of Inspection to determine:

a) control for:

condition of observance of requirements of the legislation and regulating documents in the sphere of agricultural and water economy, and also food security;

observance of requirements for the state order, procurement, separate conversion and storage of sowing seeds of cotton and grain crops;

fulfillment of requirements on stock forming of agricultural and food products in amounts according to systematic implementation of the state order;

quality, rational and target use, ensuring reliable safety and reducing losses of the state resources of grain crops, cotton and other seeds of crops, and also products of their conversion;

execution of state policy in the field of genetic purity of grades and quality of seeds of crops, work on certification of seeds according to area of accreditation, to determination and control of quality of seeds and landing materials;

rational use and protection of farmlands, strict observance of requirements of the legislation within the tasks assigned to Inspection with involvement of perpetrators to the responsibility established by the legislation;

rational, effective use and observance of rules of water use in artificial water objects;

compliance with law and other regulating documents about breeding case in livestock production in all companies, organizations and organizations irrespective of their departmental accessory and patterns of ownership;

technical condition of the agricultural, meliorative and road-building machinery, efficiency of their operation, quality, service and repair services;

b) conducting obligatory state inspection of quality of grain crops, cotton raw, seeds of crops and products of their conversion in case of export-import and intra republican transportations;

c) realization of package of measures for identification of offenses and to taking measures to elimination of the reasons and conditions promoting them;

d) conducting production on cases on administrative offenses according to the procedure, established by the legislation.

5. Approve offers of the Prosecutor General's Office and the Ministry of Finance of the Republic of Uzbekistan on education:

The state unitary enterprise "The Center for Rendering Services in Agro-industrial Complex" under Inspectorate (further - the Center);

Fund of development of Inspectorate for control of agro-industrial complex and ensuring food security under the Prosecutor General's Office of the Republic of Uzbekistan (further - Fund).

Determine that the services rendered by the Center for implementation of control functions of Inspection do not join in taxable basis.

6. Determine:

a) main objectives of the Center:

carrying out sampling and identification of products according to requirements of regulating documents;

the organization and carrying out testing of cotton fiber, cotton lint, cotton and sowing seeds of crops, and also grain and products of their conversion according to the declared area of accreditation;

issue of the certificate of conformity, performance of works on ensuring unity of measurements and implementation of metrological control;

determination of glutinosity of cotton fiber, control of mass of piles of cotton fiber and lint;

production, restoration and providing the companies of the cotton-processing and oil and fat industry, buyers of cotton products and other organizations by standard examples of appearance of the certified cotton products;

check in the soil analysis of high-quality purity of the zoned and perspective grades of crops and transfer of their results to the interested organizations;

b) sources of forming of fund:

20 percent from the income of the Center;

40 percent from the total amount of the penalties applied within powers of Inspection for violations of requirements of the legislation in the field of agricultural industry, food security and water consumption;

50 percent of the amounts from the penalties imposed by employees of Inspectorate;

80 percent of the amounts from the charges levied for technical inspection, certification, registration plates and technical data sheets of tractors, tractor trail cars, the meliorative and road-building equipment, self-propelled machines, and also agricultural machinery;

income gained from placement of temporarily available funds of Fund;

other sources which are not forbidden by the legislation.

7. Approve:

structure of central office of Inspectorate for control of agro-industrial complex and ensuring food security under the Prosecutor General's Office of the Republic of Uzbekistan according to appendix No. 1;

standard structures of managements of Inspectorate for control of agro-industrial complex and ensuring food security of the Republic of Karakalpakstan and areas, departments of areas (the city of Kuwasai) according to appendices No. No. 2 and 3;

Regulations on Inspectorate for control of agro-industrial complex and ensuring food security under the Prosecutor General's Office of the Republic of Uzbekistan according to appendix No. 4;

Regulations on Fonda of development of Inspectorate for control of agro-industrial complex and ensuring food security under the Prosecutor General's Office of the Republic of Uzbekistan according to appendix No. 5;

grades in compensation on the Single scale of charges of employees of central office of Inspectorate for control of agro-industrial complex and ensuring food security under the Prosecutor General's Office of the Republic of Uzbekistan, managements of Inspectorate for control of agro-industrial complex and ensuring food security of the Republic of Karakalpakstan and areas, departments of areas (the city of Kuwasai) according to appendices No. No. 6 - 8;

"Road map" on the effective organization of activities of Inspectorate for control of agro-industrial complex and ensuring food security under the Prosecutor General's Office of the Republic of Uzbekistan according to appendix No. 9.

8. Establish the extreme number of managerial and production personnel of Inspection in number of 1 795 units.

Grant to the Attorney-General of the Republic of Uzbekistan the right:

make, if necessary, changes to organizational and regular structures of Inspection and its territorial subdivisions within the established general number of staff;

enter additional established posts of employees of Inspectorate and its territorial subdivisions by fund.

9. Determine that Inspection:

it is headed by the chief appointed to position and dismissed by the President of the Republic of Uzbekistan;

in the activities it is accountable to the Attorney-General of the Republic of Uzbekistan.

Equate the chief of Inspectorate for the status, payment terms of work, medical and transport attendance to the deputy attorney general of the Republic of Uzbekistan.

10. Determine that:

content of Inspection is performed at the expense of the means of the Government budget of the Republic of Uzbekistan released in connection with optimization of 9 896 established posts of number of the Ministry of Agriculture, and also the abolished departments, organizations and Fund. At the same time the amount of the economy of the salary fund which is formed due to optimization of the salary fund and obligatory assignments goes to other expenses and strengthening of material and technical resources of Inspection;

persons having the higher or secondary vocational education are appointed to positions of employees of Inspectorate (lawyers, agronomists, economists, financiers, engineers and others);

assignment of class ranks to the employees of Inspectorate employed from law enforcement and other agencies is solved the Attorney-General of the Republic of Uzbekistan;

employees of Inspectorate, the having class ranks, are employees of bodies of prosecutor's office and privileges, measures of material and social protection established for prosecution agencies workers extend to them;

information, documents and other materials necessary for accomplishment of the tasks assigned to bodies of Inspectorate, are represented according to their legal requirement gratuitously;
