About approval of Safety requirements and protection of health of workers during the work with screen devices

According to article 28 of the Law of Ukraine "About labor protection", to Items 8, 10 Regulations on the Ministry of social policy of Ukraine, the Cabinet of Ministers of Ukraine approved by the resolution of June 17, 2015 order to No. 423 (with changes):

1. Approve Safety requirements and protection of health of workers during the work with screen devices which are applied.

2. Declare invalid the order of the State committee of Ukraine on industrial safety, labor protection and mountain supervision of March 26, 2010 No. 65 "About approval of Industrial safety rules in case of operation of electronic computers", registered in the Ministry of Justice of Ukraine on April 19, 2010 for No. 293/17588.

3. To department of the salary and working conditions (Tovstenko A. P.) provide submission of this order in accordance with the established procedure on state registration in the Ministry of Justice of Ukraine.

4. This order becomes effective from the date of its official publication.

5. To impose control of execution of this order on the first deputy Minister Olga Krentovskaya.

Safety requirements and protection of health of workers during the work with screen devices

I. General provisions

1. These Requirements extend to all subjects of managing, irrespective of patterns of ownership, legal form and types of activity and establish the minimum requirements of safety and protection of health when implementing the work connected with use of screen devices irrespective of their type and model.

2. These requirements are developed on the basis of the Directive 90/270/EEC of May 29, 1990 on the minimum requirements of safety and health during the work with screen devices (the fifth framework directive in value of part 1 of Article 16 of the Directive 89/391/EEC).

3. These requirements do not limit the right of the employer to establish more tough and/or special safety requirements and protection of health and life of workers during the work with screen devices if it does not contradict the current legislation.

4. These requirements do not extend on:

workplaces of job seekers of education in computer classes (offices, audiences, etc.) of educational institutions;

the workplaces of pilots, drivers or operators of vehicles equipped with screen devices in systems of data processing onboard intermedia, screen devices as a part of the machines and the equipment moved in the course of work;

workplaces of the workers who are engaged in servicing, repair and adjustment of screen devices;

portable systems of data processing if they are not always used on workplace;

computers (calculators), cash registers and devices with small devices of indication yielded or results of measurement;

the digital printing machines equipped with visual display terminals (display printing machines);

tablets, smartphones, mobile phones.

5. Terms in these Requirements are used in the following values:

screen devices - electronic means for reproduction of any graphical or alphanumeric information (on the basis of electron beam tube, liquid crystal, plasma, projective, organic LED monitors and other latest developments in the sphere of information technologies);

workplace (workstation) - set of the equipment, including the screen device which can be supplemented with the keyboard or the input equipment and/or the software, the "operator display" representing the interface, other devices (the peripheral devices which are turning on devices for electronic media, phone, the modem, the printer, the holder of documents, working chair, desktop or working surface of "smart" table, and also other necessary production circle).

Other terms in these Requirements are used in the values given in the Law of Ukraine "About labor protection".

II. General obligations of employers

1. The employer shall inform workers on receipt on working conditions and availability on their workplaces of dangerous and harmful production factors (physical, chemical, biological, psychophysiological) which arise during the work with screen devices and are not eliminated yet, and also about possible consequences of their influence on health of workers according to requirements of article 5 of the Law of Ukraine "About labor protection".

2. The employer shall provide training and examination of workers concerning labor protection and safe use of screen devices prior to work with them, and also in cases of modification and the organization of operation of the equipment.

3. The employer shall take adequate measures to provide compliance of workplace of the worker to these Requirements.

4. During arrangement of workplace of the worker with screen devices it is necessary to choose such equipment which does not create excess noise and does not generate excessive heat. Noise levels on workplaces of persons working with screen devices shall meet the requirements of Sanitary standards of production noise, ultrasound and infrasound of GSN 3.3.6.037-99, approved by the resolution of the Chief state health officer of Ukraine of December 01, 1999 No. 37.

5. The employer shall for the account of duration of working shift organize the internal regulated breaks for rest according to the State health regulations and regulations of work with visual display terminals of electronic computers GSANPIN 3.3.2.007-98, approved by the resolution of the Chief state health officer of Ukraine of December 10, 1998 No. 7 (further - GSANPIN 3.3.2.007-98).

6. The employer shall provide at own expense performing medical examinations of workers according to requirements of the Procedure for the performing medical examinations of workers of certain categories approved by the order of the Ministry of Health of Ukraine of May 21, 2007 No. 246, registered in the Ministry of Justice of Ukraine on July 23, 2007 for No. 846/14113.

By results of these surveys the employer if necessary shall provide accomplishment of the relevant improving activities.
