1. Approve the enclosed Administrative regulations of provision by Federal Agency for Subsoil Management of the state service in the organization of carrying out in accordance with the established procedure tenders and auctions on mineral right.

The administrative regulations of provision by Federal Agency for Subsoil Management of the state service in the organization of carrying out in accordance with the established procedure tenders and auctions on mineral right (further - Administrative regulations) determine terms and the sequence of ministerial procedures (administrative actions) of Federal Agency for Subsoil Management (further - Rosnedra) and its territorial authorities when implementing powers by provision of the state service in the organization of carrying out in accordance with the established procedure tenders and auctions on mineral right, except for subsoil plots of federal importance and subsoil plots of local value.

2. The state service in the organization of carrying out in accordance with the established procedure tenders and auctions on mineral right is provided to subjects of business activity, including participants of particular partnership, foreign citizens, legal entities (further - applicants).

5. Informing on provision of the state service by Rosnedra and its territorial authorities is performed:

b) with use of means of telephone, fax and electronic communication;

c) on the official sites of Rosnedra and its territorial authorities on the Internet;

d) with use of the federal state information system "Single Portal of the State and Municipal Services (Functions)" (further - the Single portal of the state and municipal services).

6. The stands containing information on graphics of acceptance of applicants are placed in case of entrance to premises of Rosnedra and its territorial authorities.

7. Information on questions of provision of the state service and on the course of provision of the specified service is provided free of charge.

8. The main requirements to informing applicants concerning provision of the state service and about the course of provision of the specified service are:

reliability of the provided information;

clearness in information statement;

completeness of informing;

convenience and availability of receipt of information;

efficiency of provision of information.

9. When informing on the course of provision of the state service the following data can be received:

a) about the entering numbers at which documents, and results of their consideration are registered;

b) about the regulatory legal acts regulating provision of the state service (the name, number, acceptance date of regulatory legal act);

c) about the list of the documents necessary for receipt of the state service;

d) about terms of provision of the state service;

e) about procedure, the size and the bases of collection of the state fee or other payment for provision of the state service.

10. Informing applicants concerning provision of the state service and about the course of provision of the specified service will be organized as follows.

Public informing is carried out in shape:

- oral informing (radio or television);

- written informing (official sites of Rosnedra and its territorial authorities, distributing information materials, information stands).

Individual informing is carried out in shape:

- oral informing (personally or by phone);

- written informing (by mail or by e-mail, through the official sites of Rosnedra and its territorial authorities, the Single portal of the state and municipal services).

e) procedure for performing procedures of provision of the state service in text form and in the form of the flowcharts given in appendices No. 2 and No. 3 to Administrative regulations;

e) order forms on provision of the state service, and also model of its filling;

g) list of the documents necessary for provision of the state service;

h) the bases for refusal in provision of the state service;

i) description of result of provision of the state service;

j) procedure for pre-judicial (extrajudicial) appeal of the actions (failure to act) and/or the decisions performed and accepted by Rosnedra and its territorial authorities, and also their officials during provision of the state service;

k) the list of the regulatory legal acts regulating provision of the state service.

l) working schedule of officials of Rosnedra and its territorial authorities.

II. Standard of provision of the state service

12. The state service in the organization of carrying out in accordance with the established procedure tenders and auctions on mineral right (further - the state service).

13. Provision of the state service is performed by Rosnedra and its territorial authorities.

14. Rosnedra and its territorial authorities have no right to demand from the applicant of implementation of actions the, including coordination necessary for receipt of the state service and connected with the appeal to other state bodies and the organizations, except for receipts of the services included in the list of services which are necessary and obligatory for provision of the state services approved by the Government of the Russian Federation.

Description of results of provision of the state service

15. Resulting effect of provision of the state service is:

decision making about approval of result of tender or auction on mineral right;

decision making about recognition of tender or auction on mineral right cancelled.

Term of provision of the state service

16. The term of provision of the state service without the circumstances interfering carrying out tenders and auctions (force majeure circumstances, that is circumstances extraordinary and impreventable under existing conditions, and also lack of quorum for meeting of the contest or auction committee), constitutes no more than 150 days for tenders and no more than 105 days for auctions from the moment of placement of the announcement of carrying out tender or auction on mineral right on the official site of the Russian Federation on the Internet for placement of information on tendering (www.torgi.gov.ru) (further - the official site).

This term can be increased by effective period of the circumstances interfering carrying out tenders or auctions on mineral right, but no more than for 7 working days according to Item 54 of Administrative regulations.
