1. Approve the enclosed Rules of collection and processing of dactyloscopic information at the citizens of the Republic of Kazakhstan applying for receipt of the passport of the citizen of the Republic of Kazakhstan abroad, foreigners and stateless persons in case of receipt of visas of the Republic of Kazakhstan.

2. To provide to department of consular service of the Ministry of Foreign Affairs of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Republican state company on the right of economic maintaining "The republican center of legal information" in the state and Russian languages for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions;

4) placement of this order on Internet resource of the Ministry of Foreign Affairs of the Republic of Kazakhstan.

3. To impose control of execution of this order on the First Deputy Minister of Foreign Affairs of the Republic of Kazakhstan Tleuberdi M. B.

4. This order becomes effective since January 1, 2021.

Chapter 1. General provisions

1. These rules of collection and processing of dactyloscopic information at the citizens of the Republic of Kazakhstan applying for receipt of the passport of the citizen of the Republic of Kazakhstan abroad, foreigners and stateless persons in case of receipt of visas of the Republic of Kazakhstan (further - Rules) are developed according to the subitem 1) of article 33 of the Law of the Republic of Kazakhstan "About dactyloscopic and genomic registration" (further - the Law) and the subitem 167) of Item 15 of the Regulations on the Ministry of Foreign Affairs of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of October 28, 2004 No. 1118, and determine procedure for collection and processing of dactyloscopic information at the citizens of the Republic of Kazakhstan applying for receipt of the passport of the citizen of the Republic of Kazakhstan abroad, foreigners and stateless persons in case of receipt of visas of the Republic of Kazakhstan.

2. In these rules the following concepts are used:

1) the stateless person - the person who is not the citizen of the Republic of Kazakhstan and not having the evidence of the belonging to nationality of other state;

2) fingerprinting - receipt of prints of the skin patterns formed by papillary lines of nail phalanxes and the palmar surfaces of hands;

3) dactyloscopic information - the biometric data on features of structure of papillary patterns of fingers and (or) palms of hands of the person allowing to identify his personality and personal data according to requirements of the Law;

4) collection of dactyloscopic information - the actions directed to receipt of dactyloscopic information;

5) processing of dactyloscopic information - the actions directed to accumulating, storage, change, amendment, use, transfer, depersonalization, blocking and destruction of dactyloscopic information;

6) dactyloscopic registration - the activities performed by authorized state bodies in the sphere of dactyloscopic and (or) genomic registration on collection, processing, protection of dactyloscopic information, establishment or confirmation of the identity of the person;

7) verification of the personality - confirmation of the personality by check on coincidence of papillary patterns of fingers and (or) palms of hands of physical person to its dactyloscopic information;

8) foreign institutions of the Republic of Kazakhstan (further - foreign institutions) - the diplomatic and equated to them representations being located abroad, and also consular establishments of the Republic of Kazakhstan;

9) the authorized employee - the employee of foreign institution performing collection and processing of dactyloscopic information, and also verification of the personality;

10) the foreigner - the person who is not the citizen of the Republic of Kazakhstan and having the proof of the belonging to nationality of other state.

Chapter 2. Collection and processing of dactyloscopic information

3. Foreign institutions perform collection of dactyloscopic information at:

1) the citizens of the Republic of Kazakhstan who addressed to foreign institutions for receipt of the passport of the citizen of the Republic of Kazakhstan for the first time, and also for their recovery or replacement, from their consent;

2) the foreigners and stateless persons which reached sixteen-year age in case of the request for receipt of visas of the Republic of Kazakhstan, except for the visas issued in electronic format without visit of foreign institution.

4. Are exempted from passing of dactyloscopic registration:

1) children is younger than twelve years;

2) in case of execution of visas of the Republic of Kazakhstan, proceeding from the principle of reciprocity (in cases of mutual provision of equal conditions in case of execution of visas of the Republic of Kazakhstan):
