Some questions of establishment of communication of disability with wounds or other damages of health

According to the paragraph to the sixth item 4 of part two of article 7 of the Law of Ukraine "About the status of veterans of war, guarantees of their social protection" the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for establishment of communication of disability with wounds or other damages of health which is applied.

2. Make change to the Regulations on procedure, conditions and criteria of establishment of disability approved by the resolution of the Cabinet of Ministers of Ukraine of December 3, 2009 No. 1317 "Questions of medico-social examination" (The Official Bulletin of Ukraine, 2009, No. 95, Art. 3265; 2012, No. 42, Art. 1618; 2015, No. 57, Art. 1869; 2016, No. 70, Art. 2356; 2018, No. 23, the Art. 782), having added with its Item 19-3 - the following content:

"19-3. The causal relationship of disability with wounds or other injuries of health received by persons who became persons with disability owing to wounds or other injuries of health received from explosives, ammunition and military arms in the territory of conducting anti-terrorist operation till December 1, 2014, and since December 1, 2014 - in the territory of conducting anti-terrorist operation where public authorities perform the powers, and in the settlements located on the line of contact during conducting anti-terrorist operation is established based on the decision of the interdepartmental commission on questions of factual determination of receipt by persons of the wounds or other injuries of health received from explosives, ammunition and military arms in the territory of conducting anti-terrorist operation.".

3. This resolution becomes effective along with the Law of Ukraine of November 14, 2017 No. 2203-VIII "About introduction of amendments to the Law of Ukraine "About the status of veterans of war, guarantees of their social protection" on strengthening of social protection of participants of anti-terrorist operation, participants of Revolution of Advantage and members of families of the died such persons".

Procedure for establishment of communication of disability with wounds or other damages of health

1. This Procedure determines the procedure of establishment of communication of disability with the wounds or other damage of health sustained faces from explosives, ammunition and military arms (further - damages of health from ammunition) in the territory of conducting anti-terrorist operation, implementation of actions for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions till December 1, 2014, and from December 1, 2014 to February 24, 2022 - in the territory of conducting anti-terrorist operation, implementation of actions for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions where public authorities perform the powers, and in the settlements located on the line of contact during conducting anti-terrorist operation, implementation of actions for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions, since February 24, 2022 - in the territory of holding the actions necessary for ensuring defense of Ukraine, protection of safety of the population and interests of the state in connection with military aggression of the Russian Federation against Ukraine (further - the territory of conducting anti-terrorist operation, implementation of actions for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions, holding the actions necessary for ensuring defense of Ukraine, protection of safety of the population and interests of the state in connection with military aggression of the Russian Federation against Ukraine).

Action of this Procedure extends also on:

persons to whom disability owing to damage of health in the territory of conducting anti-terrorist operation, implementation of measures for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions before entry into force of the Law of Ukraine of November 14, 2017 No. 2203-VIII "About introduction of amendments to the Law of Ukraine "About the status of veterans of war, guarantees of their social protection" on strengthening of social protection of participants of anti-terrorist operation, participants of Revolution of Advantage and members of families of the died such persons is established;

persons aged up to 18 years which became disabled owing to damage of health in the territory of conducting anti-terrorist operation, implementation of measures for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions before entry into force of the Law of Ukraine of May 22, 2018 No. 2443-VIII "About modification of some legal acts of Ukraine of rather social protection of injured participants of Revolution of Advantage and some other faces".

2. The area of conducting anti-terrorist operation and the period of its carrying out are determined by the anti-terrorist center under the SSU.

The list of the settlements located on the line of contact affirms the Cabinet of Ministers of Ukraine.
