About approval of form of the provisional solution of classification of goods, procedure for its filling and modification (amendments) of such provisional solution

1. Approve enclosed:

form of the provisional solution of classification of goods according to the single Commodity nomenclature of foreign economic activity of the Eurasian Economic Union;

Procedure for filling of form of the provisional solution of classification of goods according to the single Commodity nomenclature of foreign economic activity of the Eurasian Economic Union and modification (amendments) of such provisional solution.

2. Recognize invalid:

item 2 of the Decision of the Commission of the Customs union of May 20, 2010 №260 "About forms of customs papers";

items 3, 14 and 15 changes made to the Decision of the Commission of the Customs union of May 20, 2010 № 260 (appendix to the Decision of Board of the Euroasian economic commission of July 11, 2017 №84 "About modification of the Decision of the Commission of the Customs union of May 20, 2010 №260").

3. This Decision becomes effective after 120 calendar days from the date of its official publication.

Procedure for filling of form of the provisional solution of classification of goods according to the single Commodity nomenclature of foreign economic activity of the Eurasian Economic Union and modification (amendments) of such provisional solution

I. General provisions

1. This Procedure determines rules of filling of form of the provisional solution about classification of goods according to the single Commodity nomenclature of the foreign economic activity of the Eurasian Economic Union (further – the provisional solution) in document type on paper approved by the Decision of Board of the Euroasian economic commission of April 17, 2018 № 58, and rules of modification (amendments) of such provisional solution.

2. According to Item 3 of Article 8 of the Customs code of the Eurasian Economic Union the structure and format of the provisional solution in the form of the electronic document are established according to the legislation of state members of the Eurasian Economic Union (further – state members) if adoption of the provisional solution in the form of the electronic document is stipulated by the legislation state members.

3. When filling form of the provisional solution the reference books and qualifiers which are the parts of resources of single system of normative reference information of the Eurasian Economic Union, and also the reference books and qualifiers used for the customs purposes, created and which are subject to application according to the legislation of state members are applied.

4. The provisional solution, including additional leaf to it, is drawn up in printing on sheets of paper of the A4 format (210 x 297 mm) in 2 copies, one of which is intended for customs authority of the state member (further – customs authority) which made the provisional solution, and another – for person who submitted the application for adoption of the provisional solution (further – the applicant).

5. The form of the provisional solution is filled with use of printers (except for columns 10) and shall not contain erasures, blots and corrections.

6. The form of the provisional solution is filled in Russian or in state language of state member which customs authority makes such provisional solution.

If writing of names of foreign persons occurs in the documents enclosed to the application for adoption of the provisional solution, goods etc. with use of letters of the Latin alphabet, such data are specified in the form of the provisional solution by letters of the Latin alphabet.

7. If when filling form of the provisional solution in graphs there is not enough place for specifying of data, such data are specified on the sheets of format A which are in addition enclosed to such provisional solution 4, which are integral part of such provisional solution (further – amendment). At the same time in the corresponding column of form of the provisional solution the record "See Amendment" is made. All sheets of amendment shall be numbered.

On each leaf of amendment are specified:

in the right upper corner – "Amendment to the provisional solution № __________________________ on ___ l.";

number of the column of form of the provisional solution and the data for which there is not enough place in the graph of form of the provisional solution.

The customs authority for the purpose of identification of the goods specified in the provisional solution in case of need can place on additional leaf the additional information about goods (for example, the drawing, the scheme, the photographic image of goods).

Each leaf of amendment is certified of the right bottom corner by the signature of the head (deputy manager) or other official of the customs authority which made the provisional solution, authorized on it according to Item 2 of Article 82 of the Customs code of the Eurasian Economic Union (further – the authorized person of customs authority), and also if it is stipulated by the legislation state members, impress of a seal of this customs authority.

II. Filling of form of the provisional solution

8. The column 1 "Registration Number of the Provisional Solution" is filled in in the following procedure.
