the order of the Minister of national economy of the Republic of Kazakhstan of June 30, 2016 No. 295 "About modification and amendments in the order of the Minister of national economy of the Republic of Kazakhstan of April 10, 2015 No. 321 "About approval of the standard of the state services "Consideration of Petitions for Consent to Economic Concentration" (it is registered in the Register of state registration of regulatory legal acts for No. 14054, it is published on August 12, 2016 in information system of law of Ad_let).

3. To committee on regulation of natural monopolies, protection of the competition and the rights of consumers of the Ministry of national economy of the Republic of Kazakhstan to provide in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy in paper and electronic type in the Kazakh and Russian languages on official publication in periodic printing editions, and also in the Republican state company on the right of economic maintaining "The republican center of legal information" for placement and official publication in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of national economy of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of national economy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

4. To impose control of execution of this order on the supervising vice-minister of national economy of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

Standard of the state service "Consideration of Petitions for Consent to Economic Concentration"

Chapter 1. General provisions

1. The state service "Consideration of Petitions for Consent to Economic Concentration" (further - the state service).

2. The standard of the state service is developed by the Ministry of national economy of the Republic of Kazakhstan (further - the Ministry).

3. The state service appears Committee on regulation of natural monopolies, protection of the competition and the rights of consumers of the Ministry of national economy of the Republic of Kazakhstan (further - the service provider).

Acceptance of petitions for rendering the state service, and issue of results of rendering the state service is performed through:

1) office of the service provider;

2) the web portal of "the electronic government" www.egov.kz (further - the portal).

Chapter 2. Procedure for rendering the state service

4. Term of rendering the state service:

1) from the moment of delivery of document package to the service provider - 40 (forty) calendar days:

the service provider within 10 (ten) calendar days from the date of receipt of the petition checks completeness of the provided materials and notifies uslugopoluchatel on acceptance or on refusal in adoption of the petition to consideration;

on the portal the result of consideration of the petition to completeness goes to "private office" of uslugopoluchatel in the form of the notification on adoption of the petition to consideration, or motivated refusal in adoption of the petition for consideration certified by the electronic and digital authorized signature of the service provider with indication of date and number of registration;

the term of consideration of the petition for consent on economic concentration shall not exceed 30 (thirty) calendar days from the moment of adoption of the petition to consideration;

the term of rendering the state service stops, in case of impossibility of consideration of the petition, before decision making by the service provider or court according to the specified or related other petition what the service provider within 3 (three) working days from the moment of adoption of such decision notifies uslugopoluchatel in writing on paper and (or) through the portal on;

for submission of additional data and (or) documents, and also when carrying out the analysis of competitive situation in the goods markets the term of consideration of the petition stops what the service provider within 3 (three) working days from the moment of adoption of such decision notifies uslugopoluchatel in writing on paper and (or) through the portal on;

the term of rendering the state service is resumed after submission of additional data and (or) documents uslugopoluchatel and (or) state bodies what the service provider notifies within 3 (three) working days of uslugopoluchatel in writing on paper and (or) through the portal on;

the term established by the service provider for submission of information and (or) documents, at least 5 (five) working days;

the act of the service provider of the termination of consideration of the petition goes within 3 (three) working days from the moment of decision making;
