Based on provisions of Items b) and e) article 11 of the Law No. 179-XVI of July 10, 2008 on public and private partnership (The official monitor of the Republic of Moldova, 2008, Art. No. 165-166, 605), with subsequent changes and amendments, DECIDES: the Government

1. Approve project objectives of public and private partnership, the main requirements to the choice of the private partner, and also condition of public and private partnership for construction of housing estate and social facilities for the purpose of providing the General inspectorate of boundary police with office housing of employees on the parcel of land by Ploshchad 0,3984 of hectare, with cadastral number 0100214.134, in mun. Chisinau on st. of Grenoble, 111A, being under authority of Department of boundary police of the Ministry of Internal Affairs (are applied).

2. Appoint the General inspectorate of boundary police as the state body responsible for holding procedure of the choice of the private partner for the conclusion of the contract with it and supervision of execution of the specified project.

3. To impose control over the implementation of this resolution on the Ministry of Internal Affairs.

The purposes, requirements and conditions of public and private partnership for construction of housing estate and social facilities on the parcel of land Ploshchad 0,3984 of hectare, cadastral number 0100214.134, mun. Section 1. Purposes of public and private partnership

1. Main objectives of public and private partnership for construction of housing estate and social facilities are:

1) forming of fund of office housing by attraction of private investments;

2) attraction and preserving young personnel in competence by providing boundary police officers with office housing;

3) enhancement and increase in social protection of boundary police officers and members of their families;

4) problem resolution of providing with office housing;

5) reducing total expenses on construction of housing estate at the expense of resources of the government budget.

2. Specific purpose is creation of fund of office housing for employees of Boundary police which assumes:

1) financing, design, construction and commissioning of housing estate and social facilities by financial means of the private partner;

2) transfer into the ownership of the state partner of equity part in the amount of at least 25 apartments with a total area at least 1500 sq.m in the constructed housing estate or at least 25 apartments with a total area at least 1500 sq.m in other housing estates finished and put in operation, property of the private partner;

3) compliance of the apartments transferred to the state partner, the high quality standards in construction according to regulations;

4) compliance of the service premises transferred to the state partner, regulations of living space for each person established in article 13 of the Law No. 75 of April 30, 2015 on housing;

5) provision of office housing according to the Regulations on procedure for provision of office housing approved by the Order of the Government No. 914 of July 25, 2016.

Section 2. General requirements of application of the procedure of selection of the private partner

3. The choice of the private partner is performed on competitive basis.

4. The state partner creates the Commission on selection of the private partner (further - the Commission) according to the Regulations on standard procedures and general terms of selection of the private partner approved by the Order of the Government No. 476 of July 4, 2012.

5. The state partner carries out tender on selection of the private partner in one step upon termination of which appropriates the agreement on public and private partnership.

6. The state partner provides publication in the Official monitor of the Republic of Moldova of the information message about initiation of tender on selection of the private partner according to the form and content established in standard documentation on realization of public and private partnership. The information message is valid within 60 days from the date of publication in the Official monitor of the Republic of Moldova.

7. After publication of the information message about initiation of tender on selection of the private partner, the Commission carries out the procedure of award of the agreement on public and private partnership according to the Regulations on standard procedures and general terms of selection of the private partner approved by the Order of the Government No. 476 of July 4, 2012.

8. Any economic operator has the right to submit the offer on participation in tender, except as specified conflict of interest, stipulated by the legislation.

9. Several economic operators have the right to unite for submission of the general offer, at the same time they shall not legalize consolidation formally. The written agreement about consolidation should be provided in case of submission of the offer.

10. The state partner has the right to demand official registration of such consolidation only if the general offer of the selected participant is announced won competition and only if such measure is necessary condition for due agreement performance which will be awarded.

11. The commission determines the winner. If any offer does not conform to requirements, new competition will be organized.

12. The state partner in writing informs all participants on results of tender no later than 3 working days after signing of the protocol by members of the commission.

13. The commission publishes in the Official monitor of the Republic of Moldova the information message about determination of the winner of tender and its results within 5 calendar days from signature date of the agreement.
