About approval of form of the act of discrepancy of goods to the data specified in the documents necessary for implementation of their customs control, on damage of goods, their packaging or marking or on their loss

According to part two of Article 253 of the Customs code of Ukraine, I order to the subitem 5 of item 4 of the Regulations on the Ministry of Finance of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of August 20, 2014 No. 375,:

1. Approve form of the act of discrepancy of goods to the data specified in the documents necessary for implementation of their customs control, on damage of goods, their packaging or marking or on their loss (further - the act) which is applied.

2. Determine that the companies which move goods through customs border of Ukraine draw up the statement in the presence of the official of GFS customs in which zone of activities it is revealed:

discrepancy of goods to the data specified in the documents necessary for implementation of their customs control;

damage of goods, their packagings or marking;

complete or partial loss of goods.

The statement can be drawn up in 4 copies, if necessary - in bigger number of copies (the first copy is intended for the company which moves goods through customs border of Ukraine, the second - for GFS customs in the place of its creation, third - for GFS customs of appointment (if the statement is drawn up in zone of activities of customs of appointment, the third copy is not constituted), the fourth - for the owner of goods, additional copies - to the customs applicant, the sender, the receiver, etc.).

3. To GFS customs to which goods will be declared according to the chosen customs applicant (authorized by him person) by the customs regime, without fail to adopt the acts provided by the companies moving goods irrespective of the place of their creation and to consider information specified in them in case of determination of additional forms and amount of customs control for the purpose of non-admission of customs offenses.

4. Declare invalid the order of the State Customs Service of Ukraine of November 18, 2002 No. 630 "About approval of form of the act of discrepancy of goods to the data specified in documents, necessary for implementation of customs control, on damage of goods or their packagings or marking", registered in the Ministry of Justice of Ukraine on November 29, 2002 for No. 932/7220 (with changes).

5. In accordance with the established procedure to provide to department of customs policy:

provision of this order on state registration in the Ministry of Justice of Ukraine;

promulgation of this order.

6. This order becomes effective from the date of its official publication.

7. I reserve control of execution of this order and I assign to the acting as the Chairman of the Public fiscal service of Ukraine M. V Is sold.
