About procedure and conditions of creation of structural divisions in state bodies and the staff list of separate state bodies

The Council of Ministers of the Republic of Belarus DECIDES:

1. Determine that:

1.1. in state bodies * within the established number of staff proceeding from conditions and regulations of controllability can be created by heads of state bodies if other is not established by the President of the Republic of Belarus, structural divisions on:

* State bodies are understood as also public institutions and other state organizations providing activities of the President of the Republic of Belarus or state bodies which employees according to the legal acts fixing their legal status are the government civil servants.

1.1.1. to levels of management:

the first level of management – structural divisions which heads submit directly to the head of state body or its deputy, and also structural divisions which heads are at the same time deputy managers of state body;

the second level of management – structural divisions which heads submit directly to the head of the structural unit of the first level of management or its deputy;

the third level of management – structural divisions which heads submit directly to the head of the structural unit of the second level of management or its deputy;

1.1.2. to types:

for direct realization of state powers of authority and (or) ensuring accomplishment of functions of state body - department, committee, head department, management, service of the state protocol as management, department, the House (Palace) of civil ceremonies as department, the press service as department, the sector;

for ensuring activities and maintenance of state body – service, department, group, laboratory, the site, office, warehouse, base, economy, bureau, archive, library, office, expedition;

1.2. the department is the structural division of the first level of management of state body created according to legal acts;

1.3. the committee is structural division of the first level of management regional and Minsk city executive committees and at least 21 is created with the number of staff established post, including the head;

1.4. the head department is structural division of the first level of management of state body and at least 11 established posts, including the head are created with the number of staff;

1.5. the management, service are structural divisions of the first and (or) second level of management of state body and at least 5 established posts, including the head are created with the number of staff;

1.6. the department, department are structural divisions of the first and (or) second or third level of management of state body and at least 3 established posts, including the head are created with the number of staff;

1.7. the group, laboratory, the site, office, warehouse, base, economy, bureau, archive, library, office, expedition (further – group), the sector are structural divisions of the first and (or) second or third level of management of state body and at least 2 established posts, including the head are created with the number of staff;

1.8. in territorial authorities of state bodies (their departments) which are not their structural divisions, by the head of the relevant state body or higher body managements, departments, sectors, services, departments, groups with observance of the conditions and regulations of controllability determined in subitems 1.5-1.7 of this Item can be created;

1.9. the number of staff of workers can be established less than the number provided:

subitem 1.6 of this Item, for the bodies registering acts of civil status in structure of district, city executive committees and local administrations of areas in the cities and departments of territorial authorities of forced execution;

subitems 1.6 and 1.7 of this Item, for structural divisions of the first level of management of local executive and administrative organs according to the procedure of exception in coordination with Council of Ministers of the Republic of Belarus;

1.10. the number of deputy managers of structural division is determined proceeding from the number of staff of employees of structural division if other is not established by the President of the Republic of Belarus, but no more:

1 established post – in structural divisions with the number of staff from 4 to 11 established posts inclusive;

2 established posts – in structural divisions with the number of staff from 12 to 22 established posts inclusive;

3 established posts – in structural divisions with the number of staff from 23 and more established posts;

1.11. the workers performing labor functions on treat the workers performing ensuring activities and maintenance of state bodies:

to conducting document flow, archive, libraries, clerical works (except for functions on protection of the state secrets);

to the linguistic analysis, editing texts of documents;

to conducting financial accounting and reporting;

to implementation of settlings with physical persons and legal entities;

to acceptance, storage and leave of inventory items, accounting of warehouse operations;

to ensuring functioning and maintenance of program technical means, information resources, systems and networks, functioning of the computer equipment;

to operation and repair of the equipment, rooms, buildings, protection of buildings, cleaning of rooms, gardening of the territories;

to transport servicing, providing with communication;

realization of other labor functions on ensuring activities and maintenance of state bodies.

Reference of workers to the workers performing ensuring activities and maintenance of state bodies is made by the head of state body.

Availability of the state civil positions for accomplishment of the labor functions provided in part one of this subitem, except as specified, provided by subitem 1.12 of this Item is not allowed. The personal responsibility for observance of this requirement is born by heads of state bodies;

1.12. heads (their deputies) can be the government civil servants:

structural divisions of the first level of management on ensuring activities and maintenance of state bodies;

city, district and district departments (sectors) in the cities regional, Minsk city Social Security Fund of the population of managements of the Ministry of Labour and Social Protection.
