About measures for implementation of the electronic biddings in case of realization and provision in lease of the state assets

For the purpose of timely and high-quality execution of the State program on strategy implementation of actions in five priority directions of development of the Republic of Uzbekistan in 2017 - 2021 in Year of support of active entrepreneurship, the innovative ideas and technologies, and also ensuring transparency of the biddings in case of realization and provision in lease of the state assets, the Cabinet of Ministers decides creations of additional terms for private entrepreneurship, further simplification of procedures of realization of objects of state-owned property:

1. Agree with the offer of the State committee of the Republic of Uzbekistan on assistance to the privatized companies and development of the competition, the Ministry of Economics, Ministry of development of information technologies and communications of the Republic of Uzbekistan, the State committee of the Republic of Uzbekistan on land resources, to geodesy, cartography and the state inventory, khokimiyat of the Tashkent region about implementation according to the procedure of experiment in the Tashkent region of the mechanism of realization and provision in lease of the state assets through the electronic biddings.

2. Establish procedure according to which realization and provision in lease of the state assets in the Tashkent region is performed only through the electronic biddings in the form of online auctions on electronic trade platform of "E-auksion" organized by the state unitary enterprise "Center for the Organization of Electronic Online Auctions":

a) since May 10, 2018 - realization of the state real estate objects, privatizeable, including on "zero" redemption value, with condition of adoption of investment and social obligations, and also the state shares in authorized capitals (authorized capital) of limited liability companies;

b) since July 1, 2018 - provision of state-owned property in lease.

3. Approve "Road map" on development and deployment of the electronic biddings in case of realization and provision in lease of the state assets according to appendix No. 1.

4. Determine that:

all types of the registration and allowing procedures connected with exposure of the state assets to the electronic biddings are performed before their exposure to the electronic biddings;

the objects of state-owned property which are at the biddings in case of exposure to the electronic biddings are not subject to revaluation and are exposed at the price created for date of their exposure to the electronic biddings;

fee to the organizer of the biddings for carrying out the electronic biddings is performed by the seller or the lessor in the amount of no more than 1 percent from the cost of implementable object of state-owned property or the annual rent for the provided state-owned property, respectively;

realization and provision in lease of the state assets in the territories of free economic zones and small industrial zones are performed according to the procedure, determined by the corresponding regulatory legal acts;

the realization of real estate objects can be enabled by physical persons and the non-state organizations through the online auctions organized on electronic trade platform of "E-auksion", and also on other specialized electronic trading platforms with use of the software products providing equal access for participants and measure of protection of electronic documents, electronic messages and personal data from unauthorized access.

5. To the state committee of the Republic of Uzbekistan on assistance to the privatized companies and development of the competition together with the Ministry of development of information technologies and communications in a month in accordance with the established procedure to submit for approval in the Cabinet of Ministers of the Republic of Uzbekistan the project of the Regulations on procedure for carrying out the electronic biddings on realization of objects of state-owned property and provision in lease of state-owned property.

6. Confer responsibility for timely accomplishment of the actions provided by this resolution on the State committee of the Republic of Uzbekistan on assistance to the privatized companies and development of the competition, the Ministry of development of information technologies and communications and khokimiyat of the Tashkent region.

7. Make change and addition to the Regulations on procedure for provision in lease of state-owned property approved by the resolution of the Cabinet of Ministers of the Republic of Uzbekistan of April 8, 2009 No. 102 (the joint venture of the Republic of Uzbekistan, 2009, No. 4, the Art. 26), according to appendix No. 2.

8. To the state committee of the Republic of Uzbekistan on assistance to the privatized companies and development of the competition together with the Ministry of development of information technologies and communications, Bureau of forced execution under the Prosecutor General's Office of the Republic of Uzbekistan following the results of experiment till October 1, 2018 to make in the Cabinet of Ministers of the Republic of Uzbekistan offers on step-by-step implementation of system of realization of the state assets through the electronic biddings on all republic, taking into account efficiency analysis of its functioning in the Tashkent region.

9. To impose control of execution of this resolution on the deputy prime minister of the Republic of Uzbekistan - the chairman of the State committee of the Republic of Uzbekistan on investments S. R. Holmuradov, the chairman of the State committee of the Republic of Uzbekistan on assistance to the privatized companies and development of the competition of R. A. Gulyamov and hokim of the Tashkent region of G. I. Ibragimov.
