Rules of implementation of purchase of transport services and the additional services connected with their providing in case of need accomplishment of military transportations (sea, river, air and automobile) in case of threat of military safety of the Russian Federation and (or) for ensuring participation of the Armed Forces of the Russian Federation, other troops in transactions on maintenance or recovery of international peace and safety outside the Russian Federation according to the conventional principles and rules of international law and international treaties of the Russian Federation

1. These rules establish procurement procedure of transport services and the additional services connected with their ensuring in case of need accomplishment of military transportations (sea, river, air and automobile) in case of threat of military safety of the Russian Federation and (or) for participation of the Armed Forces of the Russian Federation, other troops in transactions on maintenance or recovery of international peace and safety outside the Russian Federation according to the conventional principles and rules of international law and international treaties of the Russian Federation (further - purchase of transport services) according to Item 50 of part 1 of article 93 of the Federal law "About Contractual System in the field of Purchases of Goods, Works, Services for Ensuring the State and Municipal Needs" (further - Rules).

2. The decision on need of purchase of transport services according to Rules is made by the Ministry of Defence of the Russian Federation, the Federal Service of troops of national guard of the Russian Federation (further - the state customer).

3. Based on the decision, stipulated in Item 2 Rules, the state customer send to the Ministry of Transport of the Russian Federation in writing the request about provision of information for implementation of purchase of transport services (further - the request) with indication of the following data:

a) type of necessary transport services (sea, river, air and automobile);

b) point of departure and destination;

c) amount of rendering transport services, including with indication of amount of load, the nomenclature and (or) the number of the passengers who are subject to transportation;

d) timeline for delivery of services;

e) availability at carrier of the license for work, data connected with use which are the state secret.

4. The request is considered by the Ministry of Transport of the Russian Federation with involvement of federal agencies subordinated to it no more than 7 working days in time. By results of consideration of the request Ministry sends to the state customer the following information and documents:

a) the list of persons conforming to the requirements established by the legislation of the Russian Federation to persons, performing rendering the service which is subject to purchase, and capable to render the transport services necessary for the state customer specified according to Item 3 of Rules in the request;

b) price information on which the contractor (contractors) is ready (are ready) to render transport services with application of documents, confirming such price, including the relevant proposal (corresponding) of the contractor (contractors) about the price of transport service.

5. The purchase contract of transport services is signed by the state customer with the contractor (contractors) from the list of persons specified in the subitem "an" of item 4 of Rules at the price which is not exceeding the offer on the price of the corresponding contractor (contractors), information on which is sent to the state customer according to the subitem "b" of item 4 of Rules.

6. The federal executive bodies and the organizations informed of the data which are the state secret when purchasing transport services shall create the conditions providing protection of these data.
