1. Approve the enclosed Rules of making of the customs transactions connected with departure from customs area of the Eurasian Economic Union and arrival on customs area of the Eurasian Economic Union of goods of the Eurasian Economic Union and the foreign goods transported by air or water transport, and (or) the sea.

2. To committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan (Tengebayev A. M.) in the procedure established by the legislation to provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Finance of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. This order becomes effective after ten calendar days after day of its first official publication.

Rules of making of the customs transactions connected with departure from customs area of the Eurasian Economic Union and arrival on customs area of the Eurasian Economic Union of goods of the Eurasian Economic Union and the foreign goods transported by air or water transport, and (or) the sea

Chapter 1. General provisions

1. These rules of making of the customs transactions connected with departure from customs area of the Eurasian Economic Union (further - EEU) and arrival on customs area of EEU of goods of the Eurasian Economic Union and the foreign goods transported by air or water transport, and (or) the sea (further - Rules) are developed according to Item 8 of article 386 of the Code of the Republic of Kazakhstan of December 26, 2017 "About customs regulation in the Republic of Kazakhstan" (further - the Code) and determine procedure for making of the customs transactions connected with departure from customs area of EEU of goods of EEU and foreign goods and arrival on customs area of EEU of such goods transported by air or water transport, and (or) the sea for the purpose of construction (creation, construction), ensuring functioning (operation, use) and life activities on artificial islands, installations, constructions, the state members of EEU which are outside the territory, concerning which

The Republic of Kazakhstan has the exclusive jurisdiction (further - objects), and also for the purpose of ensuring normal operation and maintenance of the air and water vessels transporting physical persons and goods between the territory of state members of EEU and objects within contracts for subsurface use.

2. Action of these rules extends to the following goods:

the goods of EEU transported by air or water transport, for the purpose of construction (creation, construction), ensuring functioning (operation, use) and the life activities of objects provided by the subitem 3) of Item 5 and Item 6 of article 385 of the Code, and also goods of EEU earlier imported on objects from other part of customs area of EEU and the goods of EEU got on the objects located on the continental shelf of state members of EEU including hydrocarbonic raw material, and (or) products of their conversion provided by the subitem 4) of Item 5 of article 385 of the Code (further - goods of EEU);

the goods placed under customs procedure of release for internal consumption to which the privileges on payment of import customs duties, taxes integrated to restrictions on use and (or) the order with these goods are applied and which are considered conditionally issued according to the subitem 1) of Item 1 of article 202 of the Code, and transported by air or water transport, and (or) the sea, for the purpose of construction (creation, construction), ensuring functioning (operation, use) and life activities Yana objects, and also for the purpose of ensuring normal operation and maintenance of the air and water vessels transporting physical persons and goods between the territory of the Republic of Kazakhstan and objects within contracts for subsurface use (further - foreign goods).

3. Action of these rules does not extend to the goods of EEU and (or) foreign goods which decreased from customs area of EEU and (or) arrived to customs area of EEU before Date of Introduction to action of these rules.
