1. Approve the enclosed Rules of confirmation of commodity importation for private use on customs area of the Eurasian Economic Union back after their export from customs area of the Eurasian Economic Union.

2. To committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan (Tengebayev A. M.) in the procedure established by the legislation to provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Finance of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. This order becomes effective after ten calendar days after day of its first official publication.

Rules of confirmation of commodity importation for private use on customs area of the Eurasian Economic Union back after their export from customs area of the Eurasian Economic Union

Chapter 1. General provision

1. These rules of confirmation of commodity importation on customs of the territory of the Eurasian Economic Union back after their export from customs area of the Eurasian Economic Union are developed for private use according to Item 2 of article 348 of the Code of the Republic of Kazakhstan "About customs regulation in the Republic of Kazakhstan" and determines procedure for confirmation of commodity importation for private use on customs the territories of the Eurasian Economic Union (further – EEU) back after their export from customs area of EEU.

Chapter 2. Procedure for confirmation of commodity importation for private use on customs area of the Eurasian Economic Union back after their export from customs area of the Eurasian Economic Union

2. In places of arrival on customs area of EEU is confirmed by physical persons that goods for private use are imported on customs area of EEU back after their export from customs area of EEU (further – back imported goods for private use).

3. For these purposes the physical person when carrying out customs control by the official of territorial authority of state revenues (further - the authorized officer) concerning back imported goods for private use submits to the authorized officer the documents or data which are the commodity importation basis for private use without payment of customs duties, taxes.

4. To the documents and data which are the basis for the return commodity importation for private use on customs area of EEU without payment of customs duties, taxes the invoice, invoice, checks and other documents and (or) data which confirm their acquisition in the territory of state members of EEU belong or confirm the status of such goods as goods of EEAS.

5. The authorized officer within ten minutes from the moment of receipt of the documents or data specified in item 4 of these rules makes the decision on acceptance or not acceptance of confirmation on the status of goods.

If the documents and data provided by physical person do not confirm the status of goods as goods of EEU, such goods are considered as foreign goods.

6. The physical person is notified on the decision made by the authorized officer without delay in oral form.
