About approval of Rules of registration or refusal in registration of the passenger customs declaration

1. Approve the enclosed Rules of registration or refusal in registration of the passenger customs declaration.

2. To committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan (Tengebayev A. M.) in the procedure established by the legislation to provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Finance of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. This order becomes effective after ten calendar days after day of its first official publication.

Rules of registration or refusal in registration of the passenger customs declaration

Chapter 1. General provision

1. These rules of registration or refusal in registration of the passenger customs declaration (further - Rules) are developed according to item 4 of article 182 of the Code of the Republic of Kazakhstan of December 26, 2017 "About customs regulation in the Republic of Kazakhstan" and determine order of registration or refusal in registration of the passenger customs declaration.

Chapter 2. Order of registration or refusal in registration of the passenger customs declaration

2. Registration of the passenger customs declaration electronically (except for the passenger customs declaration before implementation of its electronic version) is made for express loads by assignment of such declaration of the registration number created by information system of body of state revenues according to Item 5 of these rules.

3. The official of body of state revenues (further - the authorized officer) registers the passenger customs declaration no later than one working hour of body of state revenues from the moment of its giving.

4. In case of submission of the passenger customs declaration on paper the authorized officer puts down the registration number created by information system of body of state revenues in the left upper corner of the passenger customs declaration which is certified by print of personal number seal.

4-1. In case of submission of the passenger customs declaration for express loads on paper the authorized officer registers it in the magazine of registration of passenger customs declarations for express loads in paper and (or) electronic type in form according to appendix to these rules, with putting down of registration number in the left upper corner of the specified declaration.

5. Registration number of the passenger customs declaration is created as follows:

element 1 - code of the body of state revenues which registered the passenger customs declaration according to code of body of the state revenues of the Republic of Kazakhstan used for the customs purposes;

element 2 - registration date of the passenger customs declaration (day, month, two last figures of year);

element 3 - the sequence number created by information system.

6. The refusal in registration of the passenger customs declaration is drawn up by entering by the authorized officer into information system of body of state revenues of information on the reasons and date of refusal. Information on causes of failure goes to the customs applicant electronically with use of information systems.

7. The authorized officer refuses registration of the passenger customs declaration no later than one working hour of body of state revenues from the moment of its giving.

8. The refusal in registration of the passenger customs declaration submitted on paper is drawn up by the authorized officer by putting down in the Section "For Office Marks" of the main form of the passenger customs declaration of record: "It is refused registration in connection with..." with indication of the motivated reason and date of refusal. Record is certified by print of personal number seal of the authorized officer.

The passenger customs declaration with the drawn-up refusal returns to registration to the customs applicant.
