1. Approve enclosed:

1) the List of the separate customs transactions made by bodies of state revenues out of the location and (or) out of working hours of bodies of state revenues according to appendix 1 to this order;

2) Governed also places of making of separate customs transactions, and also cases of their making by bodies of state revenues out of the location and (or) out of working hours of bodies of state revenues, according to appendix 2 to this order.

2. To committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan (Tengebayev A. M.) in the procedure established by the legislation to provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Finance of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. This order becomes effective after ten calendar days after day of its first official publication.

Rules and places of making of separate customs transactions, and also cases of their making by bodies of state revenues out of the location and (or) out of working hours of bodies of state revenues

Chapter 1. General provisions

1. These rules and places of making of separate customs transactions, and also cases of their making by bodies of state revenues out of the location and (or) out of working hours of bodies of state revenues are developed according to Items 2 and 3 of article 145 of the Code of the Republic of Kazakhstan of December 26, 2017 "About customs regulation in the Republic of Kazakhstan" (further – the Code) and determine procedure and places of making of separate customs transactions, and also cases of their making by bodies of state revenues out of the location and (or) out of working hours of bodies of state revenues.

Chapter 2. Procedure for making of separate customs transactions by bodies of state revenues out of the location and (or) out of working hours of bodies of state revenues

The separate customs transactions provided in appendix 1 to this order are made by bodies of state revenues according to Rules of the customs clearance approved by the order of the Minister of Finance of the Republic of Kazakhstan of January 26, 2018 No. 73 (it is registered in the Register of regulatory legal acts at No. 16346).

3. For the purpose of making of separate customs transactions out of the location and (or) out of working hours of bodies of the state revenues determined in the List of the separate customs transactions made by bodies of state revenues out of the location and (or) out of working hours of bodies of state revenues, approved by this order, the interested person according to the reasoned statement addresses to bodies of state revenues.

4. The application is submitted in any form to body of state revenues in which zone of activities there are goods, with indication of the following data:

1) names of person, individual идентификационный/бизнес-идентификационный taxpayer number;

2) contacts (postal address, phone numbers, e-mail addresses);

3) places of making of separate customs transactions;

4) the basis(es) on which separate customs transactions cannot be made in the locations of bodies of state revenues and (or) during their work.

5. The body of state revenues considers the submitted application no more than 15 (fifteen) working days from the moment of obtaining in time, and in the cases determined in the subitem 2) of Item 9 of these rules – in time no more than 5 (five) hours from the moment of its obtaining.

6. The body of state revenues about the made decision notifies the interested person on the contacts specified in the statement.

Chapter 3. Places of making of separate customs transactions by bodies of state revenues out of the location and (or) out of working hours of bodies of state revenues

permanent customs control zones;

temporary customs control zones;

free warehouses;

special economic zones;

check-points of customs posts;

customs warehouses;

2) out of the location of bodies of state revenues belong

sea border check points;

river border check points;
