About forming and activities of the Security Council

Chapter 1. Security Council

Article 1. Status of the Security Council

1. The Security Council is the state body headed by the Prime Minister.

Article 2. Function and powers of the Security Council

1. The Security Council, according to part 2 of article 155 of the Constitution, establishes the main directions of policy in the sphere of defense.

2. The Security Council according to the proposal of the Prime Minister considers the questions connected with safety, territorial integrity and immunity of borders of the Republic of Armenia.

3. Powers of the Security Council are established by this Law and the Law of the Republic of Armenia "About defense".

4. The Security Council on the questions connected with the main directions of policy in the sphere of defense makes decisions, and on the questions entering its competence - advisory decisions.

Chapter 2. Structure of the Security Council

Article 3. Members of council of safety

1. Members of council of safety are:

1) Prime Minister;

2) ceased to be valid according to the Law of the Republic of Armenia of 16.05.2019 No. ZR-33

3) vice-Prime Ministers;

4) secretary of the Security Council;

5) Minister of Defence;

6) Minister of Foreign Affairs;

7) director of Service of homeland security;

8) chief of police;

9) chief of the General Staff of armed forces.

Chapter 3. Procedure for activities of the Security Council

Article 4. Organization and holding meetings of the Security Council

1. Activities of the Security Council are performed on joint basis by means of meetings.

2. Members of council of safety shall participate in meetings of the Security Council and vote for or against the decision of the Security Council on case in point.

3. Other persons invited by the Prime Minister also can participate in meetings of the Security Council.

4. Meetings of the Security Council are convened by the Prime Minister as necessary, but at least, than quarterly.

5. Meetings of the Security Council are held by the Prime Minister.

6. The meeting of the Security Council is competent if at least six members of council participate in meeting.

7. The meeting of the Security Council on the questions connected with the main directions of policy in the sphere of safety is competent if at least seven members of council participate in meeting.

8. The Security Council listens and takes into consideration semi-annual reports of the Minister of Defence on accomplishment of the main directions of policy in the sphere of defense.

9. The agenda of meetings of the Security Council, priority of consideration of questions and the main speakers are determined by the Prime Minister.

10. Members of council of safety have the right to represent offers on the agenda of meeting of the Security Council and the considered documents.

11. The agenda of meetings of the Security Council and the considered documents are provided to members of council of safety, as a rule, not later than five days prior to meeting.

12. To the document, specified in part 11 of this Article, can be provided to the other persons participating in meetings of the Security Council at the request of the Prime Minister.

13. The special procedure for acquaintance with the separate materials included in the agenda of meeting of the Security Council is established by the Prime Minister.

14. The agenda of meetings of the Security Council, content of the questions considered at meetings, and also results of vote are not subject to publication. Exceptions of this rule are established by the Prime Minister.

15. At the request of the Prime Minister the official report about the questions considered in the Security Council and the made decisions can be distributed.

16. The protocol of meetings of the Security Council are taken by office of the Security Council.

Chapter 4. Decisions of the Security Council

Article 5. Types of decisions of the Security Council and procedure for their acceptance

1. Decisions of the Security Council on the questions connected with the main directions of policy in the sphere of safety are accepted by at least than seven voices of members of council of safety, and advisory decisions - by a majority vote the members who are present at meeting of the Security Council.

2. Decisions of the Security Council are signed by the Prime Minister.

3. Advisory decisions of the Security Council are considered in competent authorities, and the decisions fixed in them as necessary are implemented in the legal acts adopted by these bodies.

Chapter 5. Ensuring normal activities of the Security Council

Article 6. Operating procedure of the Security Council

1. The points of order connected with activities of the Security Council are regulated by the operating procedure of the Security Council approved by the Prime Minister.

Article 7. Secretary and office of the Security Council

1. The Prime Minister appoints the secretary of the Security Council.

2. The Security Council has office which charter and the staff list affirm the Prime Minister.

3. The Prime Minister in the cases and procedure established by the law appoints and dismisses public employees of office of the Security Council.

4. Secretary of the Security Council:

1) will organize preparatory work of meetings of the Security Council;

Develops 2) and represents to the Prime Minister of the offer in connection with the agenda of meetings on the questions specified regarding the 2nd article 2 of this Law;

3) for the purpose of preparation of meetings has the right to demand from executive bodies on behalf of the Prime Minister documents, materials, and also other necessary information which these bodies shall provide no later than in seven days after receipt of request, and in urgent cases - in the shortest possible time;

4) directly directs and controls activities of office of the Security Council, and also persons who are not public employees and involved in works of Council on the contractual bases, in the cases and procedure established by the law appoints and dismisses the public employees of office of the Security Council who are not appointed by the Prime Minister, performs other powers established by the law;
