About some questions of payment of immediate state monetary compensation to the citizens who were injured owing to nuclear testing on the Semipalatinsk test nuclear test site and issues of certificates to them

For the purpose of implementation of the Law of the Republic of Kazakhstan "About social protection of the citizens who were injured owing to nuclear testing on the Semipalatinsk test nuclear test site" the Government of the Republic of Kazakhstan DECIDES:

1. Approve the enclosed Rules of registration of the citizens who were injured owing to nuclear testing on the Semipalatinsk test nuclear test site, payments of immediate state monetary compensation to them, the certifications confirming the right to privileges and compensations (further - Rules).

2. To provide to the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan payment of immediate state monetary compensation (further - compensation):

1) to the pensioners, receivers of the public social benefits who were injured owing to nuclear testing on the Semipalatinsk test nuclear test site;

2) to the working and unemployed citizens living and living from 1949 to 1990 in zones of radiation risk and in the territory with the preferential social and economic status.

3. To "People's Savings Bank of Kazakhstan" joint-stock company (in coordination):

To transfer 1) till March 1, 2006 to akims of areas (cities):

the register of the existing off-balance special accounts of citizens on which it is not made or compensation payment, with indication of surname, name, middle name of the investor, birth date, compensation amount is partially made;

the register of the closed off-balance special accounts of citizens on which compensation payment, with indication of surname, name, middle name of the investor, birth date, the amount and date of the paid compensation is completely made;

4. To Kazpochta joint-stock company (in coordination):

1) till March 1, 2006 to transfer to akims of areas (cities) lists of citizens by the cities and areas on electronic and paper carriers about payment of compensation from January 1, 1993 till December 31, 2005, with indication of surname, name, middle name of the receiver of compensation, birth date, the amount of the paid compensation;

To provide 2) to local executive bodies information on compensation payment to citizens according to their requests.

5. To akims of areas, cities of republican value, capital, areas (cities):

1) to create the special commissions and to ensure functioning on registration and accounting of the citizens who were injured owing to nuclear testing on the Semipalatinsk test nuclear test site, and issue by it of certificates, confirming the right to privileges and compensations according to Rules;

2) taking into account the need to annually provide funds for production of the certificates confirming the right to privileges and compensations by the victim owing to nuclear testing on the Semipalatinsk test nuclear test site;

3) to take measures for non-admission of the facts of repeated payment of compensation to citizens.

6. Recognize invalid:

1) the resolution of the Cabinet of Ministers of the Republic of Kazakhstan of May 26, 1993 No. 431 "About measures for implementation of the resolution of the Supreme Council of the Republic of Kazakhstan of December 22, 1992 No. 1788-XII "About procedure for enforcement of the Law of the Republic of Kazakhstan "About social protection of the citizens who were injured owing to nuclear testing on the Semipalatinsk test nuclear test site" (SAPP of the Republic of Kazakhstan, 1993, No. 18, the Art. 22);

2) Item 1 of Changes and additions which are made to some decisions of the Government of the Republic of Kazakhstan, approved by the order of the Government of the Republic of Kazakhstan of April 3, 2002 No. 397 "About modification and amendments and recognition voided some decisions of the Government of the Republic of Kazakhstan" (SAPP of the Republic of Kazakhstan, 2002, No. 10, the Art. 98);
