Some questions of Public service of quality of education

Cabinet of Ministers of Ukraine decides:

1. Approve Regulations on Public service of quality of education of Ukraine which are applied.

2. Make changes which are applied to resolutions of the Cabinet of Ministers of Ukraine.

3. Recognize invalid:

the resolution of the Cabinet of Ministers of Ukraine of May 3, 2012 No. 353 "About approval of the Procedure for the state inspection of educational institutions" (The Official Bulletin of Ukraine, 2012, No. 34, the Art. 1265);

the resolution of the Cabinet of Ministers of Ukraine of October 16, 2014 No. 538 "About approval of the Regulations on the State inspection of educational institutions of Ukraine" (The Official Bulletin of Ukraine, 2014, No. 85, the Art. 2395).

Regulations on Public service of quality of education

1. Public service of quality of education (further - Service) is the central executive body which activities go and coordinated by the Cabinet of Ministers of Ukraine through the Minister of Education and Science and which realizes state policy in education, concerning quality assurance of education, quality assurance of educational activities, implementation of the state supervision (control) of organizations of education on observance of the legislation by them.

2. The service in the activities is guided by the Constitution and the laws of Ukraine, presidential decrees of Ukraine and resolutions of the Verkhovna Rada of Ukraine accepted according to the Constitution and the laws of Ukraine, acts of the Cabinet of Ministers of Ukraine, other acts of the legislation.

3. The main objectives of Service are:

1) realization of state policy in education, concerning education quality assurance, quality assurance of educational activities, implementation of the state supervision (control) of organizations of education on observance of the legislation by them, within the powers provided by the law;

2) submitting for examination of the Minister of Education and Science of offers on ensuring forming of state policy in education on the questions which are within the competence of Service.

4. Service according to the assigned tasks:

1) generalizes practice of application of the legislation on questions, being within its competence, develops offers concerning enhancement of legal acts, acts of the President of Ukraine, the Cabinet of Ministers of Ukraine, regulatory legal acts of the ministries and in accordance with the established procedure submits them for consideration of the Minister of Education and Science;

2) books institutional audit of organizations of education;

3) makes recommendations to organizations of education (except institutions of higher education) on the organization and functioning of internal system of quality assurance of education;

4) approves by results of examination educational programs of preschool and general secondary education (except standard and those that are developed on the basis of standard);

5) is carried out by monitoring of quality of educational activities and quality of education according to the procedure, determined by the legislation;

6) will accredit public professional associations and other legal entities performing independent estimation of quality of education and educational activities of organizations of education (except institutions of higher education), keeps their register;

7) is performed within the powers provided by the law by the state supervision (control) of activities of organizations of education for observance of requirements of the legislation on education by them and issues obligatory for execution of the instruction by them on elimination of the revealed violations in certain terms;

8) exercises control of observance of requirements for the organization of external independent estimation at the request of MON;

9) studies work of local government bodies on realization of educational policy by them regarding quality assurance of education in the corresponding territory according to the law;

10) participates in development of state standards of general secondary education;

11) exercises control of accounting of children of school age regarding implementation by structural divisions of local executive bodies and local government bodies of the powers determined by the law;

12) takes part in certification of pedagogical workers according to the law;

13) exercises control of objects of state-owned property which belong to the sphere of its management;

14) is performed by consideration of addresses of citizens on the questions which are within its competence;

15) is performed by international cooperation on the questions which are within its competence;

16) performs other powers provided by the law.

5. Service for the purpose of the organization of the activities:

Provides 1) within the powers provided by the law, implementation of actions for prevention of corruption and to control of their realization in the office of Service and its territorial authorities at the companies, in organizations and the organizations which belong to the sphere of its management;

2) will organize planned and financial work in the office of Service, its territorial authorities, at the companies, in organizations and the organizations which belong to the sphere of its management, exercises control of use of financial and material resources, provides the organization and enhancement of financial accounting in the procedure established by the legislation;

3) is provided by effective and target use of budgetary funds;

4) will be organized by record keeping and archival document storage according to statutory rules;

Provides 5) within the powers provided by the law, task performance on mobilization preparation and mobilization readiness of the state.

6. The service for accomplishment of the tasks assigned to it has the right:

To involve 1) in accordance with the established procedure in accomplishment of separate works, participation in studying of single questions of scientists and specialists, workers central and local executive bodies, local government bodies, organizations of education, the companies, organizations and the organizations (in coordination with their heads);

To receive 2) gratuitously from state bodies, local government bodies, the companies, organizations and the organizations irrespective of pattern of ownership and their officials, and also from citizens and their associations information, documents and materials necessary for accomplishment of the tasks assigned to Service;

3) to convene meetings, to form the commissions and working groups, to hold scientific conferences, seminars on the questions which are within its competence;
