1. Approve the enclosed Storage precautions of other goods together with the goods which are on temporary storage in constructions, rooms (parts of rooms) and (or) on the open areas (parts of the open areas) of Authorized Economic Operator and acceptance of goods by it from carrier.

2. To committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan (Tengebayev A. M.) in the procedure established by the legislation to provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" of the Ministry of Justice of the Republic of Kazakhstan for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Finance of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. This order becomes effective after ten calendar days after day of its first official publication.

Chapter 1. General provisions

1. These rules of storage of other goods together with the goods which are on temporary storage in constructions, rooms (parts of rooms) and (or) on the open areas (parts of the open areas) of Authorized Economic Operator and acceptance of goods by it from carrier are developed according to Item 3 of Article 538 and item 4 of article 539 of the Code of the Republic of Kazakhstan of December 26, 2017 "About customs regulation in the Republic of Kazakhstan" and determine procedure for storage of other goods together with the goods which are on temporary storage in constructions, rooms (parts of rooms) and (or) on the open areas (parts of the open areas) of Authorized Economic Operator, and also acceptance of goods from carrier Authorized Economic Operator:

if the customs authority of appointment permitted Authorized Economic Operator to remove means of identification;

if means of identification were not applied and the customs authority of appointment resolved carrying out further actions with goods.

Chapter 2. Procedure for storage of other goods together with the goods which are on temporary storage in constructions, rooms (parts of rooms) and (or) on the open areas (parts of the open areas) of Authorized Economic Operator

2. In the territory of the room (part of the room) and (or) on the open area (part of the open area) of Authorized Economic Operator storage of other goods is allowed. In case of such storage the goods which are under the procedure of customs control shall be separately and have special visual designations.

3. Rooms where there will be goods under the procedure of temporary storage, the status of the customs control zone acquires. Limits of this room or platform shall be designated by special signs. In case of the room equipment the Authorized Economic Operator takes measures for ensuring safety of goods, exception of access to goods of strangers, ensuring carrying out customs control.

Chapter 3. Procedure for acceptance by Authorized Economic Operator of goods from carrier

4. Acceptance of goods from carrier by Authorized Economic Operator if the customs authority of appointment permitted Authorized Economic Operator to remove means of identification if they were applied, the Authorized Economic Operator in the presence of carrier carries out the following actions:

removal of means of identification;

survey of goods and in case of not compliance of goods in the number of places, assortment, packagings according to received to invoices, to commodity transport delivery notes or other accompanying documents the statement in which both parties append the signatures is drawn up;

draws up the acceptance act of goods in any form.

5. Acceptance of goods from carrier by Authorized Economic Operator if means of identification were not applied and the customs authority of appointment resolved carrying out further actions with goods, the Authorized Economic Operator accepts goods from carrier and are constituted the acceptance act of goods in any form if the goods correspond to all parameters and the description of shipping documents where both parties append the signatures.

In case of not compliance of goods to descriptions of shipping documents the statement with the description not of compliance where both parties append the signatures is also drawn up.

6. If the customs authority of appointment notified Authorized Economic Operator on prohibition of removal of the means of identification imposed on stowage spaces of vehicles and on need of carrying out customs examination or customs examination of the goods and vehicles placed in the customs control zone, completion of customs procedure of customs transit is performed according to Items 17, of 18, of 19, of 20, of 21, 22 and 23 Procedures for making by customs authorities of the customs transactions connected with giving, registration of the transit declaration and completion of customs procedure of the customs transit approved by the decision of the Commission of custom union of August 17, 2010 No. 438.

7. For making by customs authority of purpose of the customs transactions connected with registration of completion of customs procedure of customs transit in the cases provided by items 4 and 5 these rules, the goods placed in the customs control zone are not subject to moving to other customs control zones or on warehouses of temporary storage.
