About Standard regulations on the local permanent commissions on streamlining of traditions, celebrations and ceremonies

1. Approve Standard regulations on the local permanent commissions on streamlining of traditions, celebrations and ceremonies it (is applied).

2. To executive bodies of the government of the Gorno-Badakhshan Autonomous Region, areas, the city of Dushanbe, cities and areas and self-government institutions of settlements and dekhot in the activities to be guided by this Provision.

Standard regulations on the local permanent commissions on streamlining of traditions, celebrations and ceremonies

1. General provisions

1. The standard regulations on the local permanent commissions on streamlining of traditions, celebrations and ceremonies (further - the Provision) establish bases of the organization and activities of the permanent regional, city and district commissions, and also permanent commissions of jamias of settlements and dekhot on streamlining of traditions, celebrations and ceremonies (further - the permanent commission).

2. The provision is developed on the basis of the Law of the Republic of Tajikistan "About streamlining of traditions, celebrations and ceremonies in the Republic of Tajikistan" and other regulatory legal acts.

3. The permanent commission is created under executive bodies of the government of the Gorno-Badakhshan Autonomous Region, areas, the city of Dushanbe, cities and areas, self-government institutions of settlements and dekhot (further - local authorities) for implementation of the Law of the Republic of Tajikistan "About streamlining of traditions, celebrations and ceremonies in the Republic of Tajikistan".

4. The permanent commission in the activities is guided by the Constitution of the Republic of Tajikistan, the Law of the Republic of Tajikistan "About streamlining of traditions, celebrations and ceremonies in the Republic of Tajikistan", other regulatory legal acts of the Republic of Tajikistan and this Provision.

2. Procedure for education and organization of activities of the permanent commission

5. The permanent commission is created by the resolution (order) of the head of state local executive body of the power as a part of the chairman, the deputy, the secretary and members of the commission from 5 - 9 persons.

6. The provision of the permanent commission affirms Majlises of People's Deputies of the Gorno-Badakhshan Autonomous Region, areas, the city of Dushanbe, cities, areas, jamias of settlements and dekhot.

7. The permanent commission heads of structural divisions, the lawyer and experienced employees of local body are included. Managers of departments and sectors on religion, streamlining of traditions, celebrations and ceremonies and the chief specialist on religion, streamlining of traditions, celebrations and ceremonies is included the permanent commission as the secretary.

8. The head of local executive body of the government and self-government institutions of settlements and dekhot at the same time is the chairman of the permanent commission.

9. Meetings of the permanent commission are held at least once in three months. Members of the permanent commission take part at meetings without the right to replacement. In need of established procedure changes are made to structure of the commission.

10. The permanent commission holds meeting on the following bases:

- order of the commission chairman;

- address of the employee of local body;

- appeal of physical persons and legal entities;

- in case of identification by members of the commission of cases of violation of requirements of the Law of the Republic of Tajikistan "About streamlining of traditions, celebrations and ceremonies in the Republic of Tajikistan".

11. The meeting of the permanent commission is considered competent if more than a half of its structure participate in it.

12. The decision of meeting of the permanent commission is drawn up by the protocol. In the course of the meeting can be used audio and videos which are also applied to the protocol. The protocol is signed by the chairman and the secretary of the commission.

3. Tasks and powers of the permanent commission

Tasks of the permanent commission are implementation of supervision of execution of the Law of the Republic of Tajikistan "About streamlining of traditions, celebrations and ceremonies in the Republic of Tajikistan" and taking measures to prevention of violation of requirements of the specified Law.

14. The permanent commission for the purpose of accomplishment of the tasks has the following powers: exercise control of requirements of the Law of the Republic of Tajikistan "About streamlining of traditions, celebrations and ceremonies in the Republic of Tajikistan", other industry regulatory legal acts and this provision;

- develop recommendations and instructions for economical holding celebrations and ceremonies;

- explain requirements of the legislation and make recommendations to persons holding celebrations and ceremonies;

- register weddings on the occasion of wedding and mourning ceremonies, and also conduct statistics in this direction;

- take measures for observance of the industry legislation;

- provide interaction between state bodies and public associations on streamlining of traditions, celebrations and ceremonies and to organize educational and propaganda activities among the population;

- render practical assistance to chairmen makhally, to departments of civil registration, physical persons and legal entities in streamlining of celebrations and ceremonies;

- propagandize scientifically - popular literature on streamlining of traditions, celebrations and ceremonies;

- control and analyze work of the public commissions on streamlining of traditions, celebrations and ceremonies;

- provide coordination of work of the organizations, organizations and companies, irrespective of patterns of ownership, concerning streamlining of traditions, celebrations and ceremonies;

- receipts of information from the organizations, organizations, the companies and public associations, irrespective of patterns of ownership about accomplishment of regulatory legal acts of the Republic of Tajikistan on streamlining of traditions, celebrations and ceremonies;
