Approve Licensed conditions of implementation of economic activity on mediation in employment abroad which are applied.

Licensed conditions of implementation of economic activity on mediation in employment abroad

General part

1. These Licensed conditions establish the exhaustive list of the documents enclosed to the application for receipt of the license for implementation of economic activity on mediation in employment abroad and also the exhaustive list of the requirements obligatory for accomplishment during implementation of the specified activities.

The licensee shall fulfill requirements of these Licensed conditions, and the license applicant - it to answer.

2. In these Licensed conditions terms are used in such value:

economic activity on mediation in employment abroad - service which is provided by subjects of managing within prisoners with the foreign subject (foreign subjects) of managing of the external economic agreements (contracts) on provision of services on mediation in employment abroad for the purpose of assistance to execution of an employment agreement (employment contract) according to requests of the foreign employer of rather free workplaces (vacancies), including provision of information and consulting services concerning employment opportunities, names and the location of the employer, information on working conditions;

the foreign subject of managing - the foreign employer who uses wage labor, or the foreign subject of managing - the intermediary who has the right to perform intermediary activities for employment abroad;

information on working conditions - data on working conditions (including concerning providing proper, safe and healthy working conditions), compensations (including by the size of guaranteed wage), payroll contributions, durations of working hours and time of rest, effective period of the employment contract (contract) and condition of its termination, provision of public and medical care, implementation of social insurance, the indemnification caused to health owing to labor accident or temporary disability, repatriation of the labor migrant;

the client of the licensee - the citizen of Ukraine, the foreigner or the stateless person who on legal causes are in the territory of Ukraine and signed with the licensee the service provision agreement on mediation in employment abroad and use its services.

Other terms are used in the value given in the Laws of Ukraine "About licensing of types of economic activity" and "About employment of the population" and other legal acts which determine the relations which arise during implementation of economic activity on mediation in employment abroad.

3. The license applicant gives the method provided by part one of article 10 of the Law of Ukraine "About licensing of types of economic activity" to body of licensing the statement for receipt of the license (appendix 1).

4. Are enclosed to the application for receipt of the license:

1) data signed by the license applicant - the subject of managing, the place of implementation of economic activity on mediation in employment abroad (appendix 2);

2) the copy of the document confirming the fact of registration of the foreign subject of managing in the country of the location;

3) the copy of the permission (license) for employment of foreign citizens issued by authorized body of the state of employment to the employer if such document is stipulated by the legislation such state;

4) the copy or extraction from the document of the foreign subject of the managing determining type of its economic activity if the legislation of the state of employment does not provide issue of permissions (licenses) for employment of foreign citizens;

5) the copy of the permission (license) for implementation of intermediary activities for employment of foreign citizens issued by authorized body of the state of employment to the foreign subject of managing - to the intermediary if such document is stipulated by the legislation such state;

6) information certified by the foreign employer on the list of courts which he owns uses on other legal causes and/or crews of which manages (for which delivers crews). Such information moves in case of mediation in employment on vessels;

7) the copy of the collective agreement (agreement) between the relevant foreign employer or consolidation of employers and the trade-union organization or their professional association if the collective agreement (agreement), or the copy of the reference certified by the foreign employer that such agreement (agreement) was not signed (did not consist);

8) the copy of the external economic agreement (contract) on provision of services on mediation in employment abroad signed with foreign subject of managing, the integral appendix to which is the draft of the employment contract (contract) signed in Ukrainian or in the language used in the state of stay which shall contain the obligations undertaken by the foreign employer and information on working conditions certified by the foreign employer;

9) the copy certified by the foreign subject of managing or the statement certified by it from the document confirming legal relationship between the foreign employer and the foreign subject of managing - the intermediary, in case of the conclusion with such subject of the external economic agreement (contract) on provision of services on mediation in employment abroad;

10) the passport copy of the head of the license applicant (or the authorized representative) with mark of territorial authority of GFS of the notification on refusal because of the religious beliefs of adoption of registration number of accounting card of the taxpayer (moves only physical persons entrepreneurs who on the religious beliefs officially refused adoption of registration number of accounting card of the taxpayer, reported about it to the relevant territorial authority of GFS and have about it mark in the passport);
