About Rules of turnover of oil and gas products and requirements to computer system on control of electronic services

1. Approve Rules of turnover of oil and gas products and requirements to computer system on control of electronic services (are applied).

2. Determine that wholesale and retail sale of oil and gas products at gas stations and bases of oil and gas products is allowed only on condition of providing the gas stations and bases of oil and gas products with the equipment (columns) conforming to requirements of state standards in the presence of electronic system of accounting of transactions of leave of oil and gas products in shape "online" (and "offline" in the zones which do not have Internet access) according to the program developed by the elected subject in coordination with the Tax Committee under the Government of the Republic of Tajikistan (further - authorized state body).

3. To standardization agency, metrology, certification and trade inspection under the Government of the Republic of Tajikistan with involvement of associations, unions and subjects of the managing activities to determine the list of the equipment conforming to requirements of state standards.

4. Perform transition to the wholesale and retail turnover of oil and gas products with use of electronic system of accounting of transactions on leave of oil products and gas since July 1, 2018 for the business entities occupied with wholesale and retail sale of oil and gas products. Establish term till September 1, 2018 for installation of the equipment at gas stations and bases of oil and gas products of electronic system of accounting of transactions with oil and gas products.

5. For the purpose of realization of Item 2 of this resolution to authorized state body till May 1, 2018:

- prepare the specification for development of the program for automation of electronic system of accounting of realization of oil and gas products at gas stations and warehouses of oil and gas products, in the procedure established by the legislation for the purpose of development of this computer program to take measures for involvement of the appropriate business entity and development of the program;

- take measures for the conclusion of the tripartite agreement for realization of the mechanism of implementation of this program between authorized state body, the centers of maintenance and business entities - sellers of oil and gas products;

- for the purpose of ensuring permanent job of this system at gas stations and bases of oil and gas products to attract the servicing business entities.

6. To anti-monopoly service under the Government of the Republic of Tajikistan together with the Ministry of Economic Development and Trade of the Republic of Tajikistan and authorized state body to determine the maintenance cost for use of the program for automation of system of accounting and cash transactions, subject to payment by business entities by sellers of oil and gas products to the centers of maintenance.

7. To authorized state body, the Ministry of Energy and Water Resources of the Republic of Tajikistan with involvement of associations and unions, for the purpose of implementation of this resolution on implementation of electronic system of accounting of turnover of oil and gas products at gas stations and warehouses of oil and gas products to carry out educational and explanatory works.

8. To the Ministry of Energy and Water Resources of the Republic of Tajikistan, authorized state body, standardization Agency, metrology, certification and trade inspection under the Government of the Republic of Tajikistan, to executive bodies of the government of the Gorno-Badakhshan Autonomous Region, Sughd and Khatlon areas, the city of Dushanbe, cities and areas of republican subordination to take necessary measures for implementation of this resolution.

9. To authorized state body together with the Ministries of Justice, finance, economic development and trade and the State committee on investments and management of state-owned property of the Republic of Tajikistan according to established procedure to provide offers on modification and amendments to the corresponding regulatory legal acts, on establishment of responsibility concerning the centers of maintenance and the business entities occupied with turnover of oil and gas products who are not performing this resolution.

Rules of turnover of oil and gas products and the requirement to computer system on control of electronic services

1. General provisions

1. Rules of turnover of oil and gas products and the requirement to computer system (further - Rules) determine by control of electronic services conditions and requirements for sale of oil and gas products (further - products) at gas stations and bases of oil and gas products with use of electronic system of accounting.

2. The procedure and storage precautions, transportations, export and import of products are determined according to the regulatory legal acts of the Republic of Tajikistan and the international legal acts recognized by Tajikistan.

3. For the purpose of these rules the following basic concepts are used:

- gas station (further - gas station) - the technology complex equipped with the equipment for storage and retail sale of oil and gas products;

- the equipment on transfer of products - the mechanical equipment fixing transfer of products (column, the car, the tank and another);

- the equipment on fixing of information on leave of products - the equipment transmitting information through the Internet by means of the electronic program;

- the electronic program - it is information automatic system on information transfer about turnover of products;

- the centers of maintenance - the legal entities elected in the authorized state body established procedure who provide servicing of electronic system of accounting of products according to this resolution and the relevant agreements;

- "online" - direct information transfer about turnover of products;

4. The purpose of Rules is:

- ensuring transparency in the course of turnover of products;

- prevention and non-admission of any offenses by the subjects who are engaged in sale of products;

- rendering services in electronic provision of reports, to collection of data, development of forecasts and other actions.
