1. Approve the Provision "About the Standard Price of the State Parcels of Land on Which the Privatized State Companies and Objects, and also the Companies and Objects Constructed by Physical Persons and Legal Entities Are Located" (are applied).

Regulations on the standard price of the state parcels of land on which the privatized state companies and objects, and also the companies and objects constructed by physical persons and legal entities are located

1. This Provision is prepared according to "the II State Program of privatization of state-owned property in the Azerbaijan Republic" approved by the Presidential decree of the Azerbaijan Republic of August 10, 2000 No. 383, "Regulations on rules of sale of the state parcels of land on which the privatized state companies and objects are located and also the companies and objects constructed by physical persons and legal entities" and other corresponding existing regulatory legal acts and establishes the standard price of the state parcels of land on which the privatized state companies and objects, and also the companies and objects constructed by physical persons and legal entities are located.

The state parcels of land on which the privatized state companies and objects are located and also the companies and objects constructed by physical persons and legal entities are divided into two parts: the parcels of land which are under the buildings and capital constructions specified in technical data sheets (daleezemelny sites under structures), and the parcels of land which are not referred to this category (further - the free parcels of land).

For determination of standard price of the parcels of land the city of Baku and its suburban parcels of land are divided into 12 zones; the cities of Sumgayit and Ganja - on 6 zones; the city of Nakhchyvan, Khankendi, Ali-Bayramly, Mingachevir, Lyankyaran, Yevlakh and Shaki - on 4 zones; the cities of Naftalan, Shamakhy, Gases, Shamkir, Salyan, Dzhalilabad, the Lip, Hachmaz, Zagatala and Geychay - on 3 zones; other district centers - on 2 zones and are applied to them the corresponding zone coefficients specified in Appendices No. 1-6.

4. Approves borders of the parcels of land within the zones specified in Appendices No. 1-6 to this Provision in coordination with the State committee of town planning and architecture and the State committee on geodesy and cartography and district (city) executive body.

5. Standard price of the state parcels of land which are under the privatized companies and objects, and also the companies and objects, constructed by physical persons and legal entities in settlements and the rural zone of the republic, is determined according to "Standard prices of the earth at the cadastral prices of areas and subdistricts" approved by the resolution of the Cabinet of Ministers of the Azerbaijan Republic of July 23, 1998 No. 158.

6. Standard price of the free parcels of land is determined by multiplication of the coefficients specified in Appendices No. 1-6, on basic prices of the zones specified in Appendix No. 7.

6-1. If the standard price of the parcels of land established by this Provision below the market value created during purchase and sale of the parcels of land in the state real estate register assessment of the specified parcels of land is performed according to the Law of the Azerbaijan Republic "About estimative activities.

The hire charge of the lands belonging to the state, being in use of the state companies, managements and the organizations or on which the construction of the state objects is designed including the companies and objects constructed by legal entities and physical persons are placed, it is established according to this Provision.

8-1. Except for legal entities whose controlling stake of shares (shares) belongs to the state the rent established according to this Provision concerning the legal entities and individual entrepreneurs performing activities in industries which the coronavirus pandemic negatively affected (COVID-19) in the territory of the Azerbaijan Republic, is not estimated from April 1, 2020 to January 1, 2021.
