1. Approve the enclosed Rules of submission by railway carriers of information on the location of temporarily imported rail vehicle of international delivery and (or) containers transported on the rail vehicles including used for domestic transports.

2. To committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan (Tengebayev A. M.) in the procedure established by the legislation to provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan.

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Finance of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. This order becomes effective after ten calendar days after day of its first official publication.

Rules of submission by railway carrier of information on the location of temporarily imported rail vehicle of international delivery and (or) containers transported on rail vehicles, including, used for domestic transports

Chapter 1. General provisions

1. These rules of submission by railway carrier of information on the location of temporarily imported rail vehicle of international delivery and (or) containers transported on the rail vehicles including used for domestic transports (further - Rules) are developed according to Item 13 of article 358 of the Code of the Republic of Kazakhstan of December 26, 2017 "About customs regulation in the Republic of Kazakhstan" (further - the Code) and determine procedure for submission by railway carrier of information on the location of the Eurasian Economic Union which is temporarily imported on customs area (further - EEU) the rail vehicle of international delivery and (or) containers transported on rail vehicles, including, used for domestic transports (further - Information).

2. In these rules the following reducings are used:

1) TSMP - vehicles of international delivery, including the transported containers on rail vehicles;

2) TDTS - the customs declaration on the vehicle.

The concepts and terms used in these rules are applied according to the customs legislation of EEU and the Republic of Kazakhstan.

Chapter 2. Procedure for submission of information by railway carrier

3. For the purpose of establishment of the location of the foreign TSMP which are temporarily imported on customs area of EEU, the territorial authority of state revenues on which control there are these TSMP creates the written request containing data on registration number TDTS, number TSMP and term of temporary import of TSMP and sends it to railway carrier. At the same time, the period of request cannot exceed one year from the moment of temporary import of TSMP.

4. The railway carrier within 25 (twenty five) working days from the moment of receipt of such request sends the created answer to body of state revenues - to the initiator of request.

5. In the presence of integration of information systems of bodies of state revenues and railway carrier, for the purpose of establishment of the location of TSMP, bodies of state revenues in information system create request about the location of TSMP and goes to information system of railway carrier.

6. The railway carrier by means of information system sends the answer to required information to information system of bodies of state revenues.

7. In case of need receipts of data from railway carriers of other state members the EEU, railway carrier directs information of railway carriers of other state members of EEU on transferable carriers (paper, on disks) within 5 (five) working days from the date of their obtaining - to body of state revenues, the initiator of request.

8. The request of data at railway carrier, for the period over one year, is performed on a centralized basis - the inquiry is sent only from Committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan.

9. Data transmission between information systems of bodies of state revenues and railway carrier is performed according to the specification of technical requirements to integration of information systems of bodies of state revenues and the railway carrier approved by the parties.

10. In the presence of full integration of information systems of bodies of state revenues and railway carrier, sending an inquiry and the answer about the location of temporarily imported foreign TSMP on papers, is not required.
