About approval of sanitary regulations about the foodstuff intended for babies and children of early age, foodstuff for the special medical purposes for complete replacement of diet for the purpose of control of weight

Based on the Law No. 10-XVI of February 3, 2009 on the state supervision of public health (The official monitor of the Republic of Moldova, 2009, No. 67, the Art. 183), with subsequent changes and amendments, article 9 of the Law No. 78-XV of March 18, 2004 on foodstuff (The official monitor of the Republic of Moldova, 2004, Art. No. 83-87, 431), with subsequent changes and amendments, and for the purpose of ensuring higher level of protection of public health DECIDES: the Government

1. Approve:

1) Sanitary regulations about the foodstuff intended for babies and children of early age, foodstuff for the special medical purposes for complete replacement of diet for the purpose of control of weight according to appendix No. 1;

2) Sanitary regulations about structure and provision of information on initial and subsequent formulas and food of babies and children of early age according to appendix No. 2;

3) Sanitary regulations about structure and provision of information on the foodstuff intended for the special medical purposes according to appendix No. 3.

2. This resolution becomes effective in 12 months after its publication, except for:

1) appendices No. 1 to Sanitary regulations about structure and provision of information on the foodstuff intended for the special medical purposes which becomes effective in 3 years after publication;

2) appendices No. 2 to Sanitary regulations about structure and provision of information on initial and subsequent formulas and food of babies and children of early age which becomes effective in 5 years after publication, except for the provisions concerning initial and subsequent formulas on the basis of proteinaceous hydrolyzates which become effective in 6 years after publication;

3) appendices No. 3 to Sanitary regulations about structure and provision of information on initial and subsequent formulas and food of babies and children of early age which becomes effective in 4 years after publication.

3. At the time of entry into force of this resolution to declare invalid the Sanitary regulations of initial and subsequent formulas of food (feeding up) for babies and children of younger age approved by the Order of the Government No. 338 of May 11, 2011 (The official monitor of the Republic of Moldova, 2011, No. 82, the Art. 390), with subsequent changes and amendments, except for appendices No. 2, 6 and 9 to Sanitary regulations.

4. To impose control over the implementation of this resolution on the Ministry of Health, work and social protection.

Sanitary regulations about the foodstuff intended for babies and children of early age, foodstuff for the special medical purposes for complete replacement of diet for the purpose of control of weight

The sanitary regulations about the foodstuff intended for babies and children of early age, the foodstuff intended for the special medical purposes and for complete replacement of diet for the purpose of control of weight (further - Regulations) are transposition of Regulations (EU) No. 609/2013 of the European Parliament and Council of June 12, 2013 about the foodstuff intended for babies and children of early age, the foodstuff intended for the special medical purposes and for complete replacement of diet for the purpose of control of weight and about cancellation of the Directive 92/52/EEC of the EU Council, Directives 96/8/EC, 1999/21/EC, 2006/125/EC and 2006/141/EC of the European Commission, the Directive 2009/39/EC of the European Parliament and EU Council and Regulations (EU) to No. 41/2009 and No. 953/2009 of the European Commission (the document extends to the EEA) published in the Official magazine of the European Union by L181 of June 29, 2013.

I. General provisions

1. These Regulations establish requirements to structure and provision of information for the following categories of foodstuff:

1) initial and subsequent formulas of food;

2) baby food and foodstuff on cereal basis;

3) the foodstuff intended for the special medical purposes;

4) complete replacement of diet for control of weight.

2. These Sanitary regulations establish the list of substances which can be added to one or several categories of the foodstuff specified in Item 1, and establish regulations of updating of this list.

II. Determinations

3. For the purposes of these Regulations the following determinations are used:

retail trade - processing or conversion of food products in Items of their storage, sale or delivery to the final consumer, including sales terminals, manufacturers of dishes on carrying out or with home delivery, dining rooms at the companies and in organizations, restaurants and other suppliers of similar restaurant services, shops, supply bases of large shopping centers, wholesale stores, supermarkets;

introduction on the market - activities for ensuring availability of foodstuff in the market of the Republic of Moldova, including their storage for the purpose of distribution, offers for sale or any other form of transfer for a fee or free of charge and directly sale, distribution and other forms of transfer;

artificially created nanomaterial - any specially made material which contains one or several measurements about 100 nanometers or less or which includes the isolated functional elements, inside or on surfaces from which many have the size about 100 nanometers and less, including structures, agglomerates or aggregates which can have the size over 100 nanometers, but have the properties characteristic of nanometric scale;

the declaration on nutrition value - any message which specifies suggests idea or implies that foodstuff has certain nutritious properties thanks to:

a) the energy value (caloric content) which it has;

b) to nutrients or other substances which it contains;
