About approval of the Provision on implementation of the state program "First house"

For the purpose of enforcement of the Law No. 293 of December 21, 2017 on some measures for implementation of the state program "First house" (The official monitor of the Republic of Moldova, 2018, Art. No. 18-26, 95) DECIDES: the Government

1. Approve the Provision on implementation of the state program "First house" it (is applied).

Provision on implementation of the state program "First house"

Chapter I. General provisions

1. This Provision regulates procedure for implementation of the state program "First house" (further - the Program) approved by the Law No. 293 of December 21, 2017 on some measures for implementation of the state program "First house", the involved organizations and subjects.

2. The program is performed in all territory of the Republic of Moldova.

3. For the purposes of this provision the basic concepts are determined as follows:

the applicant of the Program - physical person which submits to one of the financing banks the application for loan granting within the Program for acquisition of housing;

the beneficiary of the Program - physical person which corresponds to selection criteria for the Program and acquires housing on credit;

housing - real estate in the form of the apartment or the individual apartment house which corresponds to conditions of this provision and can be acquired by means of the Program;

the creditor (financing bank) - the bank which obtained the license of National Bank of Moldova, allowed to participation in the Program according to provisions of the current legislation;

the guarantor - the Government on behalf of the Ministry of Finance which allocates Public organization "Organization for Development of Entrepreneurship" (further - PU ORP) the right to issue guarantees from name and at the expense of the state for benefit of the banks issuing the credits to physical persons on acquisition of housing within the Program within the limits which are annually approved on these purposes by Parliament.

the customer of guarantee - the beneficiary of the Program which credit is provided with the state guarantee;

the beneficiary of guarantee - the financing bank which obtains the state guarantee for partial covering of the credit issued to the customer of guarantee;

the state guarantee - the obligation undertaken by the guarantor before the creditor who acts as the beneficiary of guarantee, for guaranteeing in the ratio 50%, 65% or 70% (depending on the size of share of the state guarantee) from the amount of remaining balance of the mortgage loan (the main amount) issued to the beneficiary of the Program which acts as the customer of guarantee.

4. The government by means of the Ministry of Finance PU ORP gives the right to issue the state guarantees from name and at the expense of the state for benefit of creditors (the financing banks) who grant mortgage loans to physical persons for purchase of housing allowed within the Program. For execution of given power between Ministerstvom finansov and PU ORP the agreement of the order according to the sample provided in appendix is signed.
