About the organization and functioning of the National agency for researches and developments

No. 125-129, 663), with subsequent changes and amendments, parts (1) article 18 of the Law No. 98 of May 4, 2012 on the central branch public management (The official monitor of the Republic of Moldova, 2012, Art. No. 160-164, 537), with subsequent changes and amendments, and Item b) article 7 of the Law No. 136 of July 7, 2017 on the Government (The official monitor of the Republic of Moldova, 2017, No. 252, the Art. 412) DECIDES: the Government

1. Create the National agency on researches and developments as the central administrative authority in subordination of the Government.

2. Public institution "Research and development agency", the Agency on innovations and transfer of technologies of Academy of Sciences of Moldova and the Center of the international projects in subordination of Academy of Sciences of Moldova will be reorganized by merging (accession) with the National agency on researches and developments.

3. The national agency on researches and developments is successor of the rights and obligations of public institution "Research and development agency", the Agencies on innovations and transfer of technologies of Academy of Sciences of Moldova and the Center of the international projects in subordination of Academy of Sciences of Moldova.

4. Property of public institution "Research and development agency", the Agencies on innovations and transfer of technologies of Academy of Sciences of Moldova and the Center of the international projects to transfer to the National agency on researches and developments according to the Regulations on procedure for transfer of objects of public property approved by the Order of the Government No. 901 of December 31, 2015 in subordination of Academy of Sciences of Moldova.

5. Release of personnel in connection with reorganization of public institution "Research and development agency" to perform the Agencies on innovations and transfer of technologies of Academy of Sciences of Moldova and the Center of the international projects in subordination of Academy of Sciences of Moldova according to the labor law, in case of impossibility of its translation.

6. Establish the extreme number of staff of the National agency on researches and developments in number of 34 units with the annual salary fund according to the legislation.

7. Approve:

1) Regulations on the organization and functioning of the National agency on researches and developments, according to appendix No. 1;

2) structure of the National agency on researches and developments, according to appendix No. 2;

3) to organigramm of the National agency on researches and developments, according to appendix No. 3.

8. In a month from the effective date this resolution of the State office:

To provide 1) to the Government Regulations on selection, requirements to candidates and staff of the commission on candidate screen to position of the CEO of the National agency on researches and developments. About one representative of the Ministry of Education, cultures and researches, the Ministry of Economy and Infrastructure, Academy of Sciences of Moldova, the representative delegated by council of rectors of the Republic of Moldova, the representative delegated by the board of directors of the public research institutions, the representative of civil society offered by National council on participation and the representative of the State office are part of the commission;

2) to perform selection on competitive basis of the CEO of the National agency on researches and developments.

9. Before appointment of the CEO of the National agency as the Government on researches and developments the Prime Minister will designate person who will fulfill its duties.

Regulations on the organization and functioning of the National agency on researches and developments

I. General provisions

1. The regulations on the organization and functioning of the National agency on researches and developments (further - the Provision) regulate mission, spheres of activity, the main powers and the rights of the National agency for researches and developments (further - the Agency), and also the organization of its activities.

2. The agency is the central administrative authority in subordination of the Government which realizes state policy in the fields of activity assigned to it.

3. The agency is legal entity of the public law with the location in municipium of Chisinau, has seal with the image of the State Emblem of the Republic of Moldova, treasurer accounts, and also other attributes specific to bodies of public management established in the legislation.

4. In the activities the Agency is guided by the Constitution of the Republic of Moldova, the Law on the Government, the Code of the Republic of Moldova about science and innovations, presidential decrees of the Republic of Moldova, ordinances, resolutions and orders of the Government, this Provision, and also other regulations.

5. In spheres of the activities the Agency cooperates with bodies of the central and local public authority, and also with the international organizations.

II. Mission, activities, fundamental obligations and rights of the Agency

6. The agency is urged to provide high quality and efficiency for the purpose of realization of national priorities in the field of scientific research, innovations and development.

7. The agency carries out the obligations established by this Provision in the field of promotion and financing of scientific research, innovations and developments.

8. The agency carries out the following fundamental obligations:

1) realizes state policy according to the actions plans approved by the Government for the purpose of implementation of the national Program in the field of researches, innovations and developments, and also industry strategy;
