1. Approve the enclosed Rules of maintaining the database about the persons who received and spending the money and (or) other property received from foreign states, the international and foreign organizations, foreigners, stateless persons and also their inclusions and exception of the database.

2. Declare invalid the order of the Minister of Finance of the Republic of Kazakhstan of October 19, 2016 No. 556 "About approval of Rules of maintaining the database, the information about persons payees and (or) other property, about persons which presented them, the amount of the received means and other data which are subject to placement and also their inclusion and exception of the database" (it is registered in the Register of state registration of regulatory legal acts at No. 14429, it is published on November 30, 2016 in information system of law of Ad_let).

3. To committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan (Tengebayev A. M.) in the procedure established by the legislation to provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" of the Ministry of Justice of the Republic of Kazakhstan for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Finance of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this order.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of maintaining the database about the persons who received and spending the money and (or) other property received from foreign states, the international and foreign organizations, foreigners, stateless persons and also their inclusions and exception of the database

Chapter 1. General provisions

1. These rules of maintaining the database about the persons who received and spending the money and (or) other property received from foreign states, the international and foreign organizations, foreigners, stateless persons and also their inclusions and exception of the database (further – Rules) are developed according to Item 3 of article 29 of the Code of the Republic of Kazakhstan "About taxes and other obligatory payments in the budget" (Tax code), and determine procedure for maintaining state revenues of the database by bodies about the persons and (or) structural divisions of the legal entity (further – subjects) which received and spending money and (or) other property from foreign states, the international and foreign organizations, foreigners, stateless persons (further – source), and also their inclusions and exception of the database.

2. The committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan (further - authorized body) records subjects by forming of the database.

3. The authorized body provides effective functioning, safety and safety of information about the subjects placed in the Database.

Chapter 2. Procedure for maintaining the database about the persons who received and (or) spending money and (or) other property from sources and also their inclusions and exception of the database

5. Data for the database are created of the data provided by subjects to bodies of state revenues about obtaining and expenditure of the money and (or) other property received from sources in forms, the approved orders of the Minister of Finance of the Republic of Kazakhstan:

6. Maintaining the database by authorized body includes:

1) entering of information about subjects into the database and ensuring their safety;

2) change and (or) amendment of information about subjects in the database;

3) exception of information about subjects of the database;

4) the analysis and processing of the data which are in the database.

7. The exception of data of the database is performed by authorized body in the following cases:

1) submissions of the data requiring introduction of adjustments (wrong entering, modification and amendments in data, notifications);

2) availability of judgments on exception of data of the database.

8. The data containing in the database are placed in the "Register of Persons Receiving Money and (or) Other Property from the Foreign States, the International and Foreign Organizations, Foreigners, Stateless Persons Which Are Subject to Publication" form, according to appendix to these rules, following the results of half-year no later than the 20th of the authorized body following month under report on Internet resource to the address: www.kgd.gov.kz.
