1. Approve the enclosed Rules of representation of state revenues by body to authorized state bodies of data on the provided declarations on the income and property, with indication of date of representation and code of body of state revenues, as persons to whom the Law of the Republic of Kazakhstan "About anti-corruption" assigns such obligation.

2. To committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan (Tengebayev A. M.) in the procedure established by the legislation to provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in paper and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" of the Ministry of Justice of the Republic of Kazakhstan for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Finance of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. This order becomes effective after ten calendar days after its first official publication.

Rules of representation of state revenues by body to authorized state bodies of data on the provided declarations on the income and property, with indication of date of representation and code of body of state revenues, persons to whom the Law of the Republic of Kazakhstan "About anti-corruption" assigns such obligation

Chapter 1. General provisions

1. These rules of representation of state revenues by body to authorized state bodies of data on the provided declarations on the income and property, with indication of date of representation and code of body of state revenues, persons to whom the Law of the Republic of Kazakhstan "About anti-corruption" assigns such obligation (further – Rules) are developed according to the subitem 14) of Item 3 of article 30 of the Code of the Republic of Kazakhstan "About taxes and other obligatory payments in the budget" (Tax code) and determine procedure for representation of state revenues by body to authorized state bodies of data on the provided declarations on the income and property (further – Data), with indication of date of representation and code of body of state revenues, persons to whom the Law of the Republic of Kazakhstan "About anti-corruption" (further – the Law) assigns such obligation.

2. The information is provided to authorized state bodies for the purpose of implementation of article 22 of the Law.

Chapter 2. Procedure for submission of data

The committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan (further - Committee) provides access to the information service "Data on Delivery of the Declaration on the Income and Property" (further - IS) to employees of departments of state revenues on areas, the cities of republican value and the capital (further - department) based on orders of heads of departments on granting of power to the worker on administration of IS (further - the administrator).

The administrator provides access to IS to the employee of state body based on the act of state body of granting of power to the worker on identification of the facts of non-execution of obligations on submission of declarations on the income and property (further - the user).

4. Access to IS by Committee is provided within 3 (three) working days from the date of receipt of the copy of the order and information on the administrator with indication of its login (user name on Internet resource), individual identification number (further – IIN) and positions.

5. For receipt of access to IS, state body no later than March 15 of the current year the copy of the act and information on the user with indication of its login (user name on Internet resource), IIN and positions goes to department.

6. Access to IS by the administrator is provided within 3 (three) working days from the date of receipt of the documents specified in Item 5 of these rules.

7. In case of change of data on the user and the administrator within 3 (three) working days from the date of introduction change it is informed:

state body – department;

department – Committee.

In cases of the termination of powers of the user or administrator restriction in access to IS by relevant organ is provided within 1 (one) working day.

Chapter 3. Final provision

8. In case of identification of the fact of violation by persons to whom the Law assigns obligation on submission of the declaration on the income and property of terms of submission of declarations on the income and property, state bodies in time no later than October 30 of the current year notify on such facts department or authorized body on anti-corruption in the place of the stay.

In authorized body on anti-corruption information provided by part one of this Item is submitted in the following procedure:

the central state bodies – in central office;

other state bodies – in territorial subdivisions in the place of the stay.
