Based on Item e) parts (1) article 6 of the Law No. 121-XVI of May 4, 2007 on management of public property and its privatization (The official monitor of the Republic of Moldova, 2007, Art. No. 90-93, 401), with subsequent changes and amendments, article 32 of the Law No. 98 of May 4, 2012 on the central branch public management (The official monitor of the Republic of Moldova, 2012, Art. No. 160-164, 537), with subsequent changes and amendments, and article 12 of the Law No. 246 of November 23, 2017 on the state and municipal companies (The official monitor of the Republic of Moldova, 2017, Art. No. 441-450, 750), the Government DECIDES:

1. Reorganize the state company "Fintehinform" by transformation to public institution "Center of information technologies in finance" which founder is the Ministry of Finance.

2. Public institution "Center of information technologies in finance" is successor of the rights and obligations of the state company "Fintehinform".

3. To transfer property of the state company "Fintehinform" to public institution "Center of information technologies in finance" according to the Regulations on procedure for transfer of objects of public property approved by the Order of the Government No. 901 of December 31, 2015.

4. To reorganize the state company "Fiscservinform" and the state company "Vamservinform" by merging (accession) with public institution "Center of information technologies in finance". The rights and obligations of the attached legal entities completely pass to the accepting legal entity.

5. To perform release of personnel in connection with reorganization of the state company "Fintehinform", the state company "Fiscservinform" and the state company "Vamservinform" according to regulations of the labor law, in case of impossibility of its translation.

6. To perform complete cession of property from the attached legal entities to the accepting legal entity according to requirements of the Regulations on procedure for transfer of objects of public property approved by the Order of the Government No. 901 of December 31, 2015.

7. To provide the expenses connected with reducing regular personnel in connection with reorganization of the state company "Fintehinform", the state company "Fiscservinform" and the state company "Vamservinform" at the expense of own income of three reorganized units transferred to public institution "The center of information technologies in finance".

8. The carried-out functions and services provided according to the reorganized legal entities acting with regulations will be performed by public institution "Center of information technologies in finance" with ensuring compliance with provisions of the Law No. 133 of July 8, 2011 on personal data protection.

9. Before appointment of the director of public institution as the Minister of Finance "The center of information technologies in finance" the Minister of Finance will designate person who will temporarily fulfill these duties.

10. Approve:

1) the Charter of public institution "Center of information technologies in finance" according to appendix No. 1;

2) changes and additions which are made to some Orders of the Government, according to appendix No. 2.

11. To public institution "Center of information technologies in finance":

1) in a month from the date of entry into force of this resolution to provide transfer of remaining balance of financial resources from the bank accounts opened addressed to payment service providers for the bank accounts opened on the single treasurer account of the Ministry of Finance. After this term to use only bank accounts opened on the single treasurer account of the Ministry of Finance in the activities;

2) in 2-month time from the date of entry into force of this resolution:

a) organize contest for post of the director of public institution "Center of information technologies in finance";

b) develop and submit to the founder for approval structure and the extreme number of staff of public institution "Center of information technologies in finance".

12. To the Ministry of Finance:

1) in 3-month time from the date of entry into force of this resolution to develop and submit to the Government for approval methodology of calculation of rates for the services provided by public institution "Center of information technologies in finance";

2) in 2-month time from the date of approval of the specified methodology to develop and submit to the Government for approval the nomenclature of the provided services and rates for them.

13. Before approval of the methodology specified in Item 12, and the new rates calculated on its basis to apply applicable fares on the services rendered by the reorganized legal entities.

14. To the agency of the state services to make necessary changes to cadastral and constituent documents according to the statement of the owner.

15. Recognize invalid some orders of the Government according to appendix No. 3.

Charter of public institution "Center of information technologies in finance"

I. General provisions

1. The charter of public institution "Center of information technologies in finance" (further - the Charter) regulates mission, spheres of competence, function and the right of public institution "Center of information technologies in finance" (further - the Center), and also the organization of its activities.

2. The center is public institution which founder is the Ministry of Finance, has seal with the State Emblem of the Republic of Moldova and the name in official language, uses financial autonomy and has bank accounts on the single treasurer account of the Ministry of Finance.

3. The center is at the address: Republic of Moldova, municipium of Chisinau, Ulitsa Konstantin Tenase, 7.
